I'm a lawyer bros. This is probably just another example of a frivolous lawsuit. I could be wrong but I would be surpised if Nintendo pays anything via settlement or otherwise. The days when everybody wanted to settle lawsuits to avoid litigation expenses are over. There has been a shift in attitude, especially in insurance defense, toward fighting many more claims. Often this is done even when the costs of defense exceed the amount that the case could be settled for.
The message being sent to plaintiff's and their counsel is that we are not going to be victims of legal extortion. Actually it goes beyond that, they are trying to make pursuing even meritorious claims more trouble than it is worth.
I would not be surprised if this case never made it to trial, it may be tossed out on a motion for summary judgment.
