Despite almost being beaten to death, Woman charged with murder for defending herself

The general rule in the United States for use of deadly force is usually something similar to this;

1. The person must fear for their life.

2. The threat must be imminent.

3. The person must not have an opportunity to escape and if one does they are legally obligated to take it. Some states have a homestead exception where you don't have to retreat from your house.

Based on the facts as reported she was clearly not acting under justifiable deadly force as per the US standard. Sorry people, but you can't shoot soemone in the back because they're walking off with your CD player.
 
Yeah, because using the previous arguments, all people who were victims would be able to shoot their attackers in court a few days / weeks / months / years later.

Now the question becomes...is that a bad thing?
 
lol SSS since you seem to love acting within the law, I bet you just LOVE your states Dirty Harry clause pertaining to breaking and entering. That being if someone breaks into your house and you feal threatened weather they are armer OR not, you can kill them

I'm not SSS, but if he's within the law to shoot someone breaking into his house, then more power to him. I would suggest shooting to kill, because who knows what would happen if the robber lived and told some bullshit story.
 
It does not matter he has no leg to stand on if he was in the persons house unwanted. But yea I would shoot to kill as well, if not for the sole fact its one less piece of trash walking this earth

I have news for you. If someone has broken in the house and I"m in there, they're toast. .45 cal doesn't leave many survivors. However, that doesn't mean I'm not likely to get prosecuted for murder...

I'm glad you brought that up as I knew someone would. Assault does not = death penalty no matter the situation.

Look had she shot him while he was attacking her then great, shoot the motherfucker. That, however, is not the case. She shot him while her life was no longer in danger, that is a crime.
