Family lawyer...custody battle...need help....Heather? Anyone?

Hi,

My fiancee and I split. She left with my 2 year old daughter to her moms house. Her mom runs an elderly home care business and my fiancee is living with her now.

Today , I went to see my daughter and while I was inside the house I was going to take my daughter with me when my fiancees mom started to act weird and saying that she wants to taker her out.

She wanted to know where I take her and I said that I meet a friend at Starbucks and after we go to the park.

In the last year I have been battling depression and I had suicidal thoughts. Her mom thinks that I am a lunatic and I may hurt the baby, therefore she told my fiancee not to let my daughter come to see me overnight and such...

She started to push me out of the house as I was trying to reason with her and my fiancee....I just backed up and tried to expalint to her that I was invited in the house and I talked to my fiancee that I will take my baby out....

I told my fiancee if wer are not goin to be civil with each other I will take her to court.

What would a judge rule? How much would it cost?
Would I be able to get split custody?
BTW, in the past my fiancee cheated on me when we were away in Europe and I have emails that confirm that...

She keeps telling me that because I threaten her to kill myself in the past , I wont be able to get split custody.....Is she right?

No one can tell you what the judge will rule. Get yourself an attorney and be prepared for a fight. No one is going to care if she cheated on you. They will try to do what is best for the child.

If she can prove this in court the Judge can and will probably by request of the Plaintiff have you submit to supervised visitations and a comprehensive psychological exam.. The Judge will probably impose counseling etc: The best thing you can do is hire an attorney and if there is no proof of this event deny it and demand proof via your attorney.. By no means give into a request to start having test etc: it cost $450.00 or more per hour and it is useless for such things. This is nothing more than a ploy by her side to get full custody and more money in support.. Caution stop this thread now for your own peace of mind.. Consult your attorney.. i guess i have to have a kid one day to understand what it's like. To me I don't give a shit if they take the little fucker,
paying chikd support is what I wouldn't wanna do. Even then I might pay a little so she can deal with this little attention starved crying midget.

I have gone through the same thing.. My wife had the judge impose all kind of tests and things on me and it ended up costing me double child support and I lost visitation for 3 years .. just because I admitted I had a drinking problem and went into rehab for it at her request all the while her telling me we would work it out etc: as soon as I was released she went through with the divorce and it ended up costing me an thousands of dollars in attorneys fees to represent her allegations.. sad but true ,,,,,,,,,,, she has an attorney and he is the one fueling her actions at this point.. back away and hire the best attorney you can.. if she does not have an attorney then do this.. ask friends collageues etc : who the best divorce attys are in your area ,,,, take 4 days off work and go and interview with all of the best attorneys in your district. then she will not be able to hire them as a result of conflict of interest.. legal move you need to do asap... This is war kid there will be collateral damage..will she talk to you? Dont get hemmed up by being mean or disrecptful to her or her mother, family.. buy a small voice activate recorder and have it with you at all times when in the company of her and her family to protect you... Very important .. do not admit to anything derogatory in your defense.. I mean it... deny everything and demand proof.. are you having to pay temporary support? Have you been dutiful served with court papers? can you speak with her and do an uncontested divorce due to the expense of this.. you will go broke in the legal system and it will not accomplish anything... Does she work:? Does she make more than you>? Go to your family courts website and do the formula for your pay and it will tell you what your support will be each month ... Is she requesting alimony? whos name is the house in? do you have any cars.., credit cards. or anything joint with her? If so , then tommorrow get your name off of it.. try to break her before she starts.. does she work?

The only proof that she would have about my suicidal thoughts is an email towards my former boss..whom she is friends with as I dont work there anymore...Would an email from a friend of her count in court?

She is a great mom....we have nothing to fight for as far as material things...we still talk and btw, we are not married.

Yes however he will have to testify in court so your Attorney cant have it thrown out as heresay/ What happened to cause this.. very important because as soon as she hires an attorney they cause trouble by turing the two of you against one another .. your need to talk this thing out it seems like<> divorce attorneys are scum of the earth and get paid to break families apart.. I hate them... do not say anything or do anything from here on out that can be potentionally used against you.. you are living in a glass house until this is over.. the next thing her attorney will file will be a restraining order against you forbiding the contact with her and or the baby..
