Bad Back, Scoliosis un-reported in elementary, haunting me now, can Insurance help?

hey all, i remember back in elementary going thru screenings and getting like a 2 or a 3 on the scoliosis meter, but my mother never remembers the school nurse informing her about it. it was checked again in middleschool thru regular screening and not much attention was paid to it. by my 18th birthday it had developed enough to where it had begun giving me back problems and i had to go to a specialist. he said its because my right leg grew a inch longer than my left thus throwing my hips off and crookeding my spine. Ive always been really upset that my doc's never paid enough attention to this because the specialist said it would have been easy to catch and prevent with a simple insert in my shoe.

#1 So my question number one is; can I hold any of these people responsible for my pains I am suffering now if they are indeed proven to be from scoliosis? it is moderatley severe, nothing crippling but i have trouble with heavy lifting for extended periods of time, ie: wheelbarrowing loads, moving lumber etc.

and #2, I was dropped from my parents insurance coverage at age 19 because i finshed HS. I was re-added this year @ 21. I know lots of medical companies dont help with preexisting conditions in the U.S. but, do you think there is any way to get any kind of insurance claim for a new orthopedic bed or a special kind for my back?

I have real problems sleeping at night, and tossing and turning. Any help appreciated, ive been looking into scoliosis malpractice thru google.com but have been unble to find anything that I would consider of any use thus far. Thanks again

If you already have insurance I'd just go the Dr and say my back hurts. I wouldn't mention anything about it hurting while you didn't have coverage. Let the Dr go through all the BS to diagnose your problem and hope that you're covered for treatment. I doubt you'd have any rights to compensation for pain and suffering from a misdiagnosis back in the day. Scoliosis gets worse as you get older and may not have looked like much to worry about back then. If you make it sound like your back has hurt for yrs they may not compensate you for anything now. BTW-are you insured through your parent's work?
