OK. Kohlberg's theory of moral development places obedience to laws from approximately the age of 10 through adulthood. The kid knew it was illegal. Distinguishing between right and wrong occurrs at a younger age, according to both Piaget and Kohlberg.

I think the 10 year old can be helped. But it will take many years for sure. He found love and acceptance in his group,which he probably didn't get much of at home. It all really does start at home. I'm not blaming his parents only. It has alot to do with the media and what's "cool". I feel so bad for the man they beat.

I don't think the kid will ever be a normal human being. I do believe that there are some people out there who're simply wired wrong, and that no matter how hard you try to change them, they'll stay that way.

That is not an example of mob mentality. While I can't remember the psychological name for this phenomenon, it envolves the individuals assigning responsibility to others.

People should NOT be able to carry concealed weapons. Mainly because it will be the asshols with the guns and knives under their clothes that will start problems, then attck you.

They should be punished. A few years in solitary confinement should help.

There are several areas in the US that have "concealed gun" permits and the statistics do not show increases in gun homicides. This is typical doomsayer, anti-gun rhetoric.

What is going through people's minds when they think death is worse than the rest of their life rotting away in a jail cell? That is by far the worse option.

Why is it society's desire to provide for the existence of a criminal who has commited such a crime, simply because some deem jail as worse? This costs money and is a burden on society. Do away with them and get on with life. The death penalty is the ultimate elimination of a serious problem.

Vermont is also the "whitest" state and therefore the most homogeneous. It is also sparsely populated and does not have the built in tension of a large urban area. There is no real comparison.

This is not a popular argument with the anti-gun crowd, since it correctly shows the problem: the people, not the weapon. By anti-gun advocates, the simple existence of the gun in society, induces the individual to use it for violent use, which Vermont quickly disproves.

Also, this argument argues that one ethnicity is more violence prone than another. Kinda puts a kink in that racism argument of prison demographics.

Yes, it is the excuse of situational ethics. The action and intent are the only critical components of judging a situation, both are morally wrong in the above article, so the guilty should be tried to the fullest extent of the law.

It happens all of the time. Groups of people watch crimes and do nothing. People in large groups do the most awful things. If alone or in a small group, they will not act the same way.

This is still excuses. We didn't accept this in the Nuremburg Trials, we should not accept this in small groups such as this case. Each person is a moral agent and must be accountable for his/her choices and actions. Arguing "group mentality" will excuse a slew of horrible actions.

What if the older kids did 99% of the damage and the 10 year old just watched. Is he still guilty?

Then he would not be guilty of any crime. We do not expect a 10 year old to prevent a mob from beating a man to death, but we do not expect a 10 year old to partake in the beating of a man either. The 10 year old would be the one most likely to be excused, if he did partake in the crime...the 14+, no.
