Renter has quit paying rent.....

So he is three months behind his rent is what you are saying?

Technically you can't evict him, you have to get an unlawful detainer to have the sheriff evict him.

You have to give your tenant a written notice to let them know that on such and such date you will bring this to court. If he doesn't respond by that date you will have to file the unlawful detainer.

If I remember correctly the tenant will have 5 days to respond to the detainer and the court date should be within 3 weeks. (don't quote me on these time frames)

Crazy question - does he have an up to date lease?
Is it a month to month?

No lease.

I am not a contract sort of guy. Little more than attorney employment opportunities in my opinion.


I think I will start with a written statement that I would like him to move.

Hopefully no need to go legal all at once. Hopefully.
 
If there is no lease, and he can't prove he's paid rent this month...which he hasn't...that would technically make him a squatter. Cops should have no problem tossing his ass out of your house.
 
No lease. Are you paying the appropriate taxes and have the app. insurance for renting that space? If not, the can of worms just got agitated.
 
When he's not home, simply box up his stuff and put it out on the lawn. Change locks next....problem solved. He doesn't have a lease....you've got the proof of ownership...not a damn thing he can do about it. Of course, be out there keeping an eye on his stuff so it doesn't get stolen until he gets home and you can inform him that he's been tossed.
