Im not sure what I misunderstood. Oh, I see now that I have reread it. Im sorry I was not referring to the possibilty of obtaining a search warrant. In my example I was referring only to a justified entry and items in plain sight. The 3 factors you posted would easily be met in the case were entry was made for say for a "911, well fare check" and the objects were in plain sight. Again if any type of search (opening drawers, ect) occurred this would dramatically change the outcome. I have seen this first hand... By the way NYC good post!!

I heard that the sircom virus that has been going around lately had the capabilities to dial 911 through your phone line.

A few days ago I had an email receipt saying that I emailed the police. I had no idea where this came from, why would I email the police. I have a cable modem no dial up. I wonder if this could be related in anyway?

my friend's dog used to always call 911 - they had it set on the phone as a speed dial for emergencies and the phone was on a side table near the couch. the dog would jump up on the couch to look outside and somehow in the process hit the speed dial.
then the cops would come and be pissed off - happened all the time - this was back in middle school....

Dude get your phone companies records for that day. See if there was actually a call from your place. Cops can be very arrogant motherfuckers. They may be able to mess with 911 records, but not your phone companies. If there wasn't, you may have a lawsuit and harassment case against them.

They can arrest you if it is in "plain view". If the cops are in your house for lawful reasons (like a 911 call being placed) they can seixe and arrest you for any contraband that is in plain view. They can not go through draws or cabinets. IT MUST BE IN PLAIN VIEW. It is called the plain view doctrine.

I know that they wouldnt be able to press chargers THEN...but wouldnt they be able to go get a warrent after observing the gear? Also, couldnt they confiscate it when they found it( of course they could just take it...)
Regardless, now they can have their eye on you.

technically they wouldnt be able on that basis..... but knowing you have gear man they would keep an eye on you till they find the right moment ....... anyway yoiur story is kindda weird and scarry....... lol

Here is the scoop. I have to agree with M.O.D. however there are a couple of others that are right as well. I have to use other names to this story to keep things hidden...........2 years ago the police entered my buddies house house with a search warrant for Guns & Cocaine. When the police searched the house for Guns & Cocaine they found over 4 pounds of POT and some personal gear. He had like 4 bottles of test and a nice little variety of product. The police took all illegal drugs but were not used against him in the court of law because that is not what they enterend the house searching for. Plus they took my bowl because I left it over there man I was pissed ! This all happened in front of my face and I thought he was fucked but nope. Not one of those charges were punishable by law. So you know what they gave him a ticket for not having an updated city sticker on his car. And the car was parked in the fucking driveway !
