New Police Tactic!bros Read This!

Here is the scoop. I have to agree with M.O.D. however there are a couple of others that are right as well. I have to use other names to this story to keep things hidden...........2 years ago the police entered my buddies house house with a search warrant for Guns & Cocaine. When the police searched the house for Guns & Cocaine they found over 4 pounds of POT and some personal gear. He had like 4 bottles of test and a nice little variety of product. The police took all illegal drugs but were not used against him in the court of law because that is not what they enterend the house searching for. Plus they took my bowl because I left it over there man I was pissed ! This all happened in front of my face and I thought he was fucked but nope. Not one of those charges were punishable by law. So you know what they gave him a ticket for not having an updated city sticker on his car. And the car was parked in the fucking driveway !

Good thing you used "other names" to keep things hidden - I'll never figure out who "buddy" or "I" are. Wait a minute, was that YOUR pipe ZeroCool.

I am sure something else was at play here - such as their warrent was limited to search only a particular place in the house, and they went beyond that. Because otherwise it sounds like they found the pot and the gear through a valid search. Thanks for the scoop.

1Banshee, I think you misunderstood VTAT's post. The 911 call can certainly provide the police probable cause to enter the premises. Under the plain view doctrine, the following 3 factors must be present to seize an item in plain view:
1. Officers must be legally on premises (i.e. they cannot violate the 4th Amendment to get onto or inside of the premises);
2. Incriminating nature of object must be immediately apparent (police must have probable cause to believe the object is incriminating such as contraband, stolen property, or evidence of a crime); and
3. Officer must have lawful access to the object itself. For instance, if the police are strolling by the window of your house and see gear strewn about your apartment, the police may not immediately seize the items, because they do not have lawful access to your apartment. They'll have to go get a warrant.



VTAT is correct in saying that the police may not get a search warrant based on illegally obtained information. To clarify his point, if the police, in this case, went inside of the apartment and searched containers (i.e. items not in plain view), the police would not have a right to then go and get a warrant based upon their illegal observations. VTAT was not denying the plain view doctrine.

Thanks for the info everybody, and i am following up on a couple of those suggestions i.e. getting phone records. I was already going to move next week so thats cool too. Its really scary they can just come in when ever they want...

My answer to this

I don't think the cops should of done that, but they can search anybodys house , if they know something is going on . (FBI)
Another thing is just say they arrest you for gear or pot or anything that has your finger prints on it (thats thier proof with the prints on it) you really have to be doing something bigtime in order for then to do this.
And then again if thier is no finger prints on any item they take for proof , you will win the case.

Take a look at O.J Simsons case, I thought this was an awsome case ( like everyone say money talks bullshit walks)
and hey even if he did'nt do Maybe Mark Furman planted it ,LOL
