Ack...Fuck Me...DUI

So thanks to everyone who took the time to respond, I do appreciate it. Other than the few of you who had to make the posts saying that I should have died.

So I hired a lawyer that specializes in DUI's and has been in the bus' for 25+ years. He says at a minimum he expects my case to be dropped to a wet reckless, he thinks he may be able to get it thrown out all together so we will see, I have my fingers crossed and trying not to stress out about it.

Not what I needed financially right now but you gotta do what you gotta do. So thanks once again all of your opinions are valued I appreciate the responses!!

what I try and impresson my clients is this: If you get this dropped, don't count it as a "pass", consider it as a conviction with $$ to the lawyer as the punishment! From what you said, you don't drink that often, but in TX, if your pulled over again, the record will show a DWI w/o a conviction. That tells the DA that you already had one shot and for some reason was let out of it. They're not supposed to take that into consideration, but most do. FYI

just for future reference just cause your state limit is .08 for example doesn't mean you still cant be pulled over and get your car towed but go to jail for even drinking just a little bit.

a friend of mine got pulled over cause he was lost and the cop thought he was drunk and did a sobriety test and my friend is so damn goofy that the cop took him to jail where he blew a .02 (he had like not even 1 beer).. just cause the state limit is .08 doesn't mean if you blow a .01 a cop cant techniqually take you to jail.

he ended up having to hire a 3K attorney plus fees.. his BMW ended up getting a huge scratch from the tow company.. and he had to make repeated trips 5 counties away to meet with the lawyer etc. after all was said and done he managed to get it taken off his record but it was a major hassle. cost him thousands + embarassment + waste of time.

so the lesson is dont drink and drive PERIOD. even if its 1 beer.

and to answer your question you need to interview several attorney's.. find the one that plays golf with the prosecutor.. if you have no prior record you should be able to do this fine. and get your charges lowered so that you end up with no jail time and some fines and community service. just avoid jail. and if you are lucky you can get it taken off your record. unfortunately people who cannot afford good attorney's are the suckers you hear that end up going to jail for DUI's. its an unfair system but at the same time if you have a lawyer who knows how to negotiate for you it can make all the difference. in other countries if you know the judge or a politician you get off, in the US its all about having a great negotiater

Anyone driving while under the influence of alcohol or drugs deserves to wrap their car around a tree before exploding in to a big fiery ball of fire, preferably on a quiet stretch of road so no one else has to suffer for your stupidity & selfishness.

The UK is trying to now implement zero tolerance of drink driving limits & quite rightly so; the sentences imposed on people for killing / maiming other people while DUI or pre-occupied with texting are laughable. Want to kill someone & serve only 6months-2 years custodial sentence? Drive 2 tonnes of steel & rubber in to them at 70mp/h while texting with one hand & downing a quarter bottle of Finnlandia vodka in the other.

harsh but i agree in most cases. the fact they put others at risk is what makes me sick. imagine if a drunk driver killed your wife or gf. then some of you on here that want to defend drunk driving wont be so fast to.

i would also put those losers who drive 100+mph in crappy cars that are not designed to go that fast in that group as well. or those who want to race on the roads to look cool then ram into a father coming home from a 12 hour shift at night to support his family.
