I have An Employee Question ABout Family Medical Leave

One of my employees(who is late alot) wants to go with his sister to take his mom to Houston for TEST not surgury. My secretary says that he thinks this is medical so it won't count towards his vacation. The tests last a week. If it was a day or two, I wouldn't care but a week for test for his mother seems a little excessive to me. What is the rule on this? Anybody know? I am in Texas btw if that makes a difference?

How would you want to be treated if you were in his situation?

Do the decent thing and let him have the time off.

Family Medical Leave is a federal law that typically applies to mothers of newborns - they can take 12 weeks UNPAID time off.

Other situations can be counted as FMLA - I am not sure how it works though.

I would just tell your employee he can have the time UNPAID, and no, it won;t count as vacation.

Fairly, I guess. I mean he kind of messes around during the day. And he constantly has medical problems with him and his mother. And I have been real laxed on that. I guess I feel he is taking advantage of me being easy. Like I said he sister is going to. And I would have no problem letting him have the time off unpaid but I think he thinks he should be paid for it.

I had an employee that used FMLA a couple of years ago. If I remember correctly, they're required to use all vacation and personal time first, which is tracked as FMLA leave, and then they're allowed something like 6 months total of unpaid leave.

Thanks. That seems fair to me.
