Once again, what is this thread originally about?

I know that alot of people wish to air out personal conflicts and such, but what is this entire thing about once again? I have seen so much to know that certain people are utterly despised and apparently there must be legitimate reasons to antagonize such disdain and loathing, but back to the point?

Would someone give point to point reasons for this issue to be raised so that we can all be reminded since people tend to post without reading sometimes? Me being sort of a new COTB has kind of forgotten even though I read the origin of the thread. Although I am sure that some will go back to remind me and say, "Duh!" I'm like most other members though...I"m lazy, I don't care, what?

Yeah his blog has quite the mind-numbing, obsessively long replies on this topic I think I've ever seen on ANY blog. The surest sign of guilt there is. I can't even read more than a paragraph of it before my eyes start rolling back in my head. Bullshit overload.

Surely this thread has run its course & most have had their say. I would suggest that now this thread is becoming destructive to the general integrity of the board. The supplement industry is fraught with people that are greedy & have only their own agenda in mind, in persuit of money & power. None of us are squeeky clean. If you are an AAS user, you are breaking the law in most countries. So please let this all go, let the Admin deal with whatever situation they are in, & lets just get back to what we do best on this board, helping each other out. Please LOCK THIS THREAD DOWN NOW!

I think you should take it a step further and delete this thread and your article altogether. Stuff like this can only backfire on us (the Elite community). Pointing fingers at these guys about the BS products they are selling, whilst you sell sex and gambling at the same time is hypocritical at best. Especially so when you put "God willing" at the end of your article. Mocking God is a guaranteed way to ensure you will lose this battle with BC and AR.

AND - All I am saying that George Spellwin is trying to look like he is taking some kind of moral high ground with hopes that "God" is on his side. And, at the same time he is selling other products that "God" (regardless of what god he is referring to) would most likely deem immoral. I think this is a bad idea. agree, and like any other industry, i think the industry has some stand-up bros as well who actually have a passion for what they do not just $$$---

from personal experience--I have had countles exchanges with Nelson, Omega and PP---and lately Donnie Darko, and to a man, not one has pushed their products on me and two actually sent me down a different road alltogether.

BTW, I hate seeing this crap. I wish that people did not torch the bridges behind them as they left. I agree that the mod/sponsor positions were not the best idea. But, let me ask this to GS without being edited by others who have a vested interest. Is the relationship with the AF guys so far gone that you wouldnt consider having them back in a limited capacity as sponsors/chairmen? Both sides have thrown stones. But, if you bring them back, I buy a lifetime plat tomorrow.

I just really didn't pay much attention to AR when he was here. Just judging from his avi pic is was clear he couldn't practice what he was preaching. It was like the skinny guy at the supp shop trying to sell you some bs supps and claiming from experience when he looks like he's never set eyes on a weight room.

I know this analogy is tired. But, Dan Duchaine was no Dorian Yates either. But, AR is in a hell of a lot better shape than Dan ever was. Trust me on this one. I met DD several times.

I had the strong impression long ago that anthony roberts was entirely full of shit and directly linked to the 'roid store..........although post after fucking post I made providing this fucking fact got deleted over and over and over.

I can't believe the advertising for the bullshit 'roid store went on as long as it did,honestly.it was seriously dishonest and cheated some of our naive members out of loads of cash.I just hope the settlement doesn't allow these cocksuckers to advertise much more here,or this place has basically went to hell.

Anthony Roberts sent me a private message stating that he wasn't connected to the 'roid store at all,and truthfully for a little while I actually bought into it,but still thought that he was shady as hell.now that the truth is out,it just proves what a sack of shit he actually is.

My view was not defending anyone but with litigation by pure definition there are always two sides to a story / case i.e the claimant and the defendant

From what has been written here there are several issues to deal with including advertising contracts (possibly breach), copyright issues and the owners and maybe some libel.

My view is a pure legal one which is do not do your dirty washing in public as it can be all used in the litigation case. The ONLY benefit i can see is to build up a character reference either bad or good for one of the sides but it does archive to antagonize the other side. What good does that do if you are confident and had legal advice you have not breached contract, copyright or broken any advertising agreement?

I am not defending anyone i am saying i do not agree with the approach suggested from either party for displaying the case in public as it means it makes mediation just about impossible which only upsets any judge and does ensure a lengthy and very costly court case.

By all means get mad at me but i do not know who is right or wrong in this case as i do not have the contracts or copyright to make that judgment. Basically litigation is not about right or wrong its about who has upheld the contract.

I have not been employed to defend anyone and if i had the first thing i would stop is threads like this and AR's blog as it makes it so much harder and serves not one purpose for the case. On the positive side if i was employed i would be rubbing my hands together because i know there will be hardly any chance of mediation but a very expensive daily charge for my services ion court - happy days

So may i ask if for argument sakes Elite has breached a copyright & breached an advertising contract (it is irrelevant in he case if you like the product or not) do you defend the Directors attitude to fight the case all the way at the risk of the business becoming insolvent. That in turn would ensure loss of jobs and suppliers loss of money. I am guessing you have not seen the contracts either to say 100% 9which can never be done in litigation) it would be a victory for either side.

So because you do not like the claimant or defendant and their products you would risk the company ensuing all the happy members and staff of both boards lose out?

With respect you are far to emotional about the whole issue without the facts. I do not know who is right or wrong but guess the court will let us all known when they have decided. By all means you get mad at me but they are the facts

Perhaps the resolution of this will lead to the re-establishment of the integrity of elite. the school of hard knocks is a good teacher, george. he is not compensated for those or any efforts. mods do not get paid--they do it because they like to help.

which is why if you appreciate his help buy his book.

Isn’t that curious? “D-Anabol 25” made from “Metandesenolone” sounds an awful lot like the real brand name drug Dianabol produced by pharmaceutical giant Ciba containing the real pharmaceutical methandrostenolone.

Isn’t that curious? “D-Anabol 25” made from “Metandesenolone” sounds an awful lot like the real brand name drug Dianabol produced by pharmaceutical giant Ciba containing the real pharmaceutical methandrostenolone.

"My lawyer contacted me and basically told me what they’re offering as a settlement to me, and it’s EXACTLY what I told those fucking pricks I had wanted back in December. I’m not 100% sure why they needed to pay a lawyer to give me what I want. I’m also not 100% sure what Brian’s settlement is either, but since he owns the copyright to the book they infringed on, he’s likely getting a very decent settlement. However, as they have engaged in libel against both myself as well as Brian (with that mailer), that is again, a totally different situation, and again, will likely be a totally new set of lawsuits unless they print a retraction. And I think it’s very likely that they will do just that - since they’ve just offered settlements to both myself as well as Brian, I think it is highly likely that they either do not have the money to fight us (bit off more than they could chew), and they will simply lose the case(s) even if they did have the money.

So I’m predicting a full retraction of that mailer sometime soon, as well as my getting my books back (and selling them on Steroid.com), and some other cool stuff. But in the end, the most damaging thing Elite did (other than lose money and look stupid) is that they gave us the initiative to enter the e-book market and compete with them. Frankly this isn’t a huge deal to us - the company doesn’t need to grow in that direction, but we’ve decided to do it anyway, and that (of course) means a much smaller piece of the e-book market for EF from now on.

Sometimes a commercial view has to be taken as with any litigation it is very expensive for all involved just on legal fees never mind if you win or not as you have to pay to get to court. Litigation can go on for months / years before you even get to court and there is considerable expense preparing.

Also you have to look at what you can win. If you win and get awarded damages can the defendant or claimant actually pay them. If the organisation is liquidated as a result then what benefit to you get other than proving your point at a considerable cost of legal fees.

The ones that are certain to win are the legal teams as they get their money on account pre doing any work so if possible and negotiation can bring a resolve then its always worth investigation and trying to agree.

Unfortunately due to posts like this and the blog it forces both claimenet and defendant into a position its hard to back down from. But at what cost do you put that would it be at the risk of Elitefitness or steroid.com as a business as it could well end up like that

The only people that will make out in a case like this are the attorneys. Period. There is no big financial victory at the end for anyone. So ultimately, it is in EF's and George's best interest to settle this case rather than to waste EF's resources dragging it on. I know George is fully committed to the site and its members though, and highly doubt he is going to agree to any settlement that hurts the community.

If I had my guess, I would think George just wants to make sure no settlement contains an agreement for continued Roidstore advertising. It sounded from reading GS's first post that this was the big thing they wanted to settle the case.

You also need to be prepared to spend far more money protecting IP rights that you'd ever expect to recover. Courts VERY RARELY force the losing party to cover expenses of the victor, unfortunately.
 
As an adjunct to Bill's comments I can testify to exactly what he is saying with a case I was involved with several years ago now. Not to go into too much detail but it was over copyright infringment and ended up in federal court. It took 3 years to actually get it into court to begin with and I spent in the vicinity of $120,000 over those 3 years in "legal wrangling". I ended up winning my case before the federal court and had costs awarded for me (i was defendant) but the court has a scale of costs and relates directly to actual court time and does not cover associated costs leading up to trial so I was awrded $20,000 in court costs leaving me out 100K plus there were other issues concerning confiscated stock etc that was held for 3 years and was then practically worthless after trial.

So in the end the lawyers certainly do get richer but the parties involved, even when you win end up servely out of pocket.

As many of you know, our servers are located outside of the US. Digger is trying to set up a second presence in another data-center in another country. The goal is to prevent EF from going down if our ISP went bankrupt, experienced a natural disaster, had a catastrophic power failure etc. All these events are incredibly unlikely to happen, but you can never be too protected. Setting this up is very expensive and everyone would much rather we spend the company's money on a new second data center presence than on a lawsuit. Of course we have the money to fight Steroid.com and RoidStore.com, but I cannot think of a more stupid use of money... Unless it was the decision to sue us in the first place over a book we did not write so you could attempt to capture all of our ad space for your RoidStore.

Exactly. It would be nice to fight over principles, but usually it is better to look at the big picture. GS is a reasonable guy, so I am sure he is making his decisions with the EF community in mind.

Respectufully--I and i do mean it--I have 3 eds of your book--I disagree: if the IP right is registered fed there is a mandatory atty's fees provison in the Acts-moreover, it is a business decision--if you rely on a common law right to protect your property rights, you take the good with the bad--there is no common law right to atty's fees in the US. you may have some under state law, but those are usually preempted by the fed law (or limited to the net % of the case that was brought under state law e.g. unfair comp. laws).

To get back to my original point, it is usually best to settle these things if you can. There usually isn't a pot of gold waiting for you at the end when you are suing some other middle-level business owner. Get a claim against Wallmart or something and it is a different story.

yes. i remember two offhand--federal trademark infringement suits. as far as collecting the fee--when the payment is made by the defendant and deposited into my trust account--i promise you the firm gets paid--however, as Bill noted that is assuming the defendant can pay and --the kicker is the total amount is taxable to the plaintiff--so if they win $100 and get $25 in atty fees, the plaintif is taxed as if the awared was $125.

in trademark suits, they key is if you don't sue to enforce your rights, you can lose your rights to the mark itself--som macdonalds is not being mean when it sues the hamburger stand up the street, it has to to defend its exclusive right to the mark. so even the infringer has no $$, you have to sue or risk losing the mark.

(3) the costs of the action. The court shall assess such profits and damages or cause the same to be assessed under its direction. In assessing profits the plaintiff shall be required to prove defendant’s sales only; defendant must prove all elements of cost or deduction claimed.

in trademark suits, they key is if you don't sue to enforce your rights, you can lose your rights to the mark itself--som macdonalds is not being mean when it sues the hamburger stand up the street, it has to to defend its exclusive right to the mark. so even the infringer has no $$, you have to sue or risk losing the mark.

the important thing is to make sure you write or create somthing that warrantes infringement by the like of someone with more resources that AR---a judgment against him is hate to say it, but not worth the paper it is written on

Glad all are seeing sense and hope it can be resolved. If not it has to go to court but even if you win it can just be a pride thing as there is as Bill says no pot og gold at the end of this one

So then, why would you bother settling out of court with him. Then its a win win situation. If you dont settle, he has to sue you and prove your guilt. This is something that will cost him a lot of money & he knows he is not certain to win. It seems to me he just thinks this is an easy way to make a quick buck. If Ef sues him on principle, as you say eddym, there is still no gaurantee of getting any money out of him. Where is the justice in that?

I'm afraid there is no justice. The real winners are the lawyers unfortunately.
 
Litigation and justice are NOT the same thing. The only ones sure to win every time are the lawyers
