My view was not defending anyone but with litigation by pure definition there are always two sides to a story / case i.e the claimant and the defendant
From what has been written here there are several issues to deal with including advertising contracts (possibly breach), copyright issues and the owners and maybe some libel.
My view is a pure legal one which is do not do your dirty washing in public as it can be all used in the litigation case. The ONLY benefit i can see is to build up a character reference either bad or good for one of the sides but it does archive to antagonize the other side. What good does that do if you are confident and had legal advice you have not breached contract, copyright or broken any advertising agreement?
I am not defending anyone i am saying i do not agree with the approach suggested from either party for displaying the case in public as it means it makes mediation just about impossible which only upsets any judge and does ensure a lengthy and very costly court case.
By all means get mad at me but i do not know who is right or wrong in this case as i do not have the contracts or copyright to make that judgment. Basically litigation is not about right or wrong its about who has upheld the contract.
I have not been employed to defend anyone and if i had the first thing i would stop is threads like this and AR's blog as it makes it so much harder and serves not one purpose for the case. On the positive side if i was employed i would be rubbing my hands together because i know there will be hardly any chance of mediation but a very expensive daily charge for my services ion court - happy days
So may i ask if for argument sakes Elite has breached a copyright & breached an advertising contract (it is irrelevant in he case if you like the product or not) do you defend the Directors attitude to fight the case all the way at the risk of the business becoming insolvent. That in turn would ensure loss of jobs and suppliers loss of money. I am guessing you have not seen the contracts either to say 100% 9which can never be done in litigation) it would be a victory for either side.
So because you do not like the claimant or defendant and their products you would risk the company ensuing all the happy members and staff of both boards lose out?
With respect you are far to emotional about the whole issue without the facts. I do not know who is right or wrong but guess the court will let us all known when they have decided. By all means you get mad at me but they are the facts
