I could be mistaken but I think there was a case in Florida like that and one in Texas. I believe that in both states that they had a year to dispute paternity from the time of the divorce. However, I could be wrong.

It is weird but I did have a guy who came in to my office once with similar facts. He knew when the girl was prego that the baby was not his. She had broken up with the dad and he and her started dating. He wanted to marry her and be the baby's father. So, he signed the acknowledgment of paternity when the child was born. A couple of years passed and they broke up. He paid child support for a few years but they had some sort of fight and then he didn't want to pay anymore.

I told him that I thought his time had elapsed to dispute it but that I would have to look it up if he wanted to dispute it. I told him that if he successfully disputed paternity, though, that would mean that he would also have no right to visitation. I told him to go home and sleep on it and call me in the morning. Like clockwork, he called me and told me he didn't want to do it. Men seem to get really hung up on the money thing. Obviously, he still wanted to be the kid's father. It just took an honest lawyer who didn't just go after what he wanted to make a big fee to make him look at the big picture.

Most states have laws that if you get a test done 3-5yrs later, then you still have to pay child support.


Also, giving her the money (and most girls) is like feeding a stray kitty. It will keep coming back for more. Until, you stop then you are a "loser", and it finds someone else to feed it.

As far as the stray kitty, that could be true. It works both ways. I had a guy who I paid a ticket for once and then he must have thought I was his sugar momma. lol.

If he were my client, I would tell him that we could determine paternity after the baby is born. If he wants to give her money before them, it is a personal decision of his to make, but that he isn't legally obligated. I don't twist my clients' arms on any moral issues. I try to limit things to just the facts and the law.

If it were my brother or son or friend, I would tell him that I would do the honorable thing and help her out once. If she turns out the be a jerk then it is her conscience that will have to deal with it.

HR! I swear, your pretty smart , or is it pretty and smart....whatever, but sometimes you come up with the most hairbrained crap I swear. THE GIRL IS A LIAR!! SHE DON'T GOT NO CONSCIENCE!! She's in it to see what much she can take him for. period! Want proof? Look at what she was most interested in, rent, elec bill, whatever it was. How many girls that you know asked for bill money and didn't say anything about medical expenses, child support, who the hell he really is since she knew him only a matter of hours, what he intends to do in the future if the baby is his, etc. She even left hreself an out as to not look like a complete conwoman by telling him that it MAY be another mans, that way she can justify taking the money and then telling him later, "good news, it's not yours!" only after she has said she needed all this medical shit done and wanted him to "pay for just half" of it.

You mark my words, she's done this before, has a gf/ sister that pulls this scheme, make people lives hell for a couple of months then gets hell hell outa Dodge. My guess is she's on the pill or unable to have kids and makes shure guys like him hit it raw. That starts the ol' ball rollin'.

1) don't pay for shit, nada, nothing, zero, zip
2) tell her that you will want your own DNA test done after the birth
3) don't contact you until the baby is born, then you'll have an attorney for her to call with all requests
4) refer to #1

Just take my word for it, experience is costly, I've paid for plenty. Not this exactly, but close enough to know what's up.
