I know it is long, but please read all the way through. I'm sure everyone will have an opinion.
Here is the deal. I have two great danes, one male one female. My neighbor two doors down has three extremely aggressive pit bulls. In the past year I have had 4 seperate incidents with our dogs.
The first time one of the pits and my friend's dog started fighting through my fence via the alley. I chalked that up to an accident. It could happen to anyone and not very much harm was done.
The second event happened about a month later when I was taking out the trash. I had to jump in the dumpster to keep from getting attacked. I didn't think too much about that one either because technically I nothing got attacked. It very well could have run up to me barking, growling and snarling without doint anyting wrong.
The third event was when I was taking out my garbage again and my very large male was out there with me. The largest pit and my dane fought for a couple of minutes, but stopped after several repeated hits to the back of the pit's head with an iron bar. At this point I was getting rather aggravated with the whole situation. Circumstances or not, these dogs are starting to really be a problem and pose some sort of threat to me, and my property. I know the owners and while we aren't actually friends, I don't want any bad blood on the block. I swore if anything else happened I would call animal control.
Well, today it happened. I was doing dishes and when I looked out the window I saw their largest pit crash through one of my fence posts and clamp down on my female's snout. The second pit's head came through the fence above the first about the time my male made it across the yard. My male attacked the head of the second pit and due to the size/strength of my dane and the awkward position of the pit's head through the fence he was able to injury and scare it away. By this time I was running out the back door and I saw my male attack the back of the remaining pit's neck. In one yank he got some skin and broke off the choke chain of the pit. The first thing I could find was a four foot long metal bar that weighed about 40 lbs. In one swing I caught the pit, who was halfway into my yard and still clamping down on my dogs mouth, in the back of the head. The pit released and ran off.
The entire time I was running off pure adrenaline. When it was over I ran to the phone and called the police and animal control. Animal control came over just in time to see the dogs come back over to my fence for round two. In addition to this, she saw the fence and how it was broken inwards, blood all over my fence, my females face, and the broken choke chain. When she drove around to the back all three dogs ran into their backyard. Upon further inspection she noticed the back gate didn't have a latch and none of the dogs were chained up. When she got back to my front door she said the (pardon my use of words, I'm not racist in any way, I mean this very literally) Mexicans were very rude, aggressive and uncooperative with her.
After the Animal control left I called the police once again and asked one of the officers, off the record, what could be done. He said technically there isn't any criminal offense uless the witnessed the dogs in my yard, or partially in my yard. Therefore he said his hands were tied. But, he told me to keep records and documentation of everything that happens and to be sure and call the city code office tomorrow to file another complaint and possibly instigate a change. Finally he said, "I have a little girl and I shake at the thought of animals like that. If it comes even slightly in your yard again I'd shoot it."
It makes me mad there is nothing I can do. I am looking at a several hundred dollar emergency vet bill that I can't afford, and in the VERY best case a possible small claims court settlement a half year away. After talking to several people I keep hearing the same thing over and over. Put some poison in a slab of meat and toss it over the fence.
My impulse and instincts tell me this is exactly what needs to be done, however, this is illegal. It is wrong to be a vigilante, and the only thing that can come of doing something like this is a) me getting in trouble and b) the personal satisfaction of doing it.
After stepping back and looking at the big picture I came to a realization. My dog is going to be ok, i'm ok, and my yard and house (minus a couple fence pickets) are ok. If I keep documenting and reporting everything then eventually I will recieve satisfaction right?? Then I had a chilling thought.
My house backs up the the large hospital district. There are doctors offices on my street, not to mention every single building on the other side of the alley. Parking lots open freely to the alley. I lost my breath when this became apparent.
Does anyone have an older mother that sees a dermatologist, or a girlfriend that sees an OB/GYN? What about a little sister or daughter that has problems with her eyes? Well, a dermatologist, an OB/GYN, and an optomistrist all have seperate buildings no more than 30 feet from the gate that is supposed to keep these dogs in. Every day I see people coming and going, and honestly it is a miracle there hasn't been anything too serious yet.
How would I feel, what kind of guilt would I carry, if three or four months from now, when school is coming to close for the summer, I open the paper and some 4 year old girl was killed by these animals. How could I handle my friends, neighbors, or anyone's mother having to sit in a wheel chair because a pit bull injured her leg so badly she couldn't walk. At the trial the prosecution would surely bring up the fact that many complaints have been filed. I'll bet the owners would get in serious trouble as well. But I'll also bet that the owners of the pits, the lawyers, the judge, the jury, and every other person in the courtroom would wish that something had been done before it came to this.
Please no macho one line responses saying "id cook the fukers and eat them," or "shoot all three of them." I need some sort of insight on this situation. From pit bull owners, dog owners, people that have been attacked, people that have been on a dog attack jury, people that have gone through this, or even people that know about laws pertaining to this. I do live in texas so keep that in mind. Thanks for your time.
