he sat on him and repeated smashed his skull into the concrete ground if I recall correctly.
the combination of not breathing and head trauma I think were the cause.

if he rolled over and smacked the shit out of him and then got up and walked away, it would have been obvious that he could have won - but in the moment he instead decided to make sure the guy never got up again...
there was a crowd of people, including his own kid(s?) there.

Sounds to me like the guy should have went with temporary insanity. Probably would have walked...

Didnt he only punch the guys 3 times when he was on top?

Why 6 -10? To rehabilate him? To keep him off the streets cause hes a menace to society? No, the only reason he's in jail is for punishment. Punishment for standing up for himself. What would anyone else have done if they were in a fight and ended up top?

I wouldnt care if he moved next door to me. Hes just a regular guy who was pushed passed his limit.

I would have probably fought back without pounding the other guy's head into the concrete several times and killing him.

It's a sad day when society finds murder excusable. Humanity as a whole is such a pathetic species.

I don't know. I don't see a problem with defending oneself with the necessary force to subdue his opponent without bringing him excessive harm. Banging his head against the concrete was neither necessary nor even remotely within the murderer's rights. He took it to the extreme and killed him, and now he SHOULD have to pay for it, but, unfortunately, he will get off with a slap on the wrist.

:xeye:

sounds like he had a prior history of violence as well. he didnt have pre-meditation in the sense it was blood lust that motivated him so the mximum sentence wouldnt happen legally....i just cant believe people think him totally flying off the handle and killing someone is acceptable

did you know that this incident wasn't the first time the accused committed an act of violence? He was convicted of domestic violence in 1991.

He got what he had coming to him.

sadly he had to rob a child of his father, even if that father was an asshole

Please, A slap on the wrist is not 6-10 yrs. A slap on the wrist is probation. The judge just gave him what he thought was the minimum. He could have gotten and excessive prison sentence of 20+.

He's just a guy that took it too far and killed the guy in pure rage.
He is not a cold blooded murderer. I have been in several fights were my rage towards the person is so much that if I was not pulled off the guy I would just keep pounding him so hard that he would end up in the hospital or possibly worse. It's just an uncontrollable rage towards another person that you can't control and that's why this guy is not a murderer but what he did was wrong.

He is not your model citizen and has somewhat of a checkered past but you just make him out to be this huge piece of shit low life. Funny because you don't even know the fucker and your passing judgement.

In my opinion, people that pass jugdement without actually knowing the person are pieces of shit.

Murder does not require premeditation - that is why there are (at least) two different charges. Murder One is premeditated with malice and intent, Murder in the Second Degree is what this man is guilty of, yet was not charged with.

I can't believe it either. People simply do not think.

It's ok for a woman to drown her 5 children because she's a nutjob. It's ok for a man to kill a boy's father over a hockey game because it was "an accident." What's next? It's ok to shoot the President because you thought it was a bear? It's ok to call in a bomb threat because you didn't think anyone would believe you?
