Cops like to do what ever they want wherever you live. They are taught how to "write reports." They know the law and know how to right reports to make a bad search a good search. Which is why he needs a good lawyer. Its one thing to write the perfect report, its another to stick to it under heated cross examination.

I'm not from SC and I know that cross examination might work in other places, but I've been here for about five years now and its WAY different here.

First off I have seen them come up with false warrants, illegal searches, I have seen restraining orders given without cause, and thats not even the half of it. Most of the cops I know here all get gear from another one of my friends, and get thier weed for free from peeps that they bust.

The magistrate (Kenny Ward) here is my friends dad, and we have seen him with prostitutes, or woman that he has let off on charges, he drives with his 18month foster child in his lap, and he should of been busted for D.U.I so many times.

The magistrates will back up the cops 110%, and if your lawyer is not local good luck getting a fair trial.

like i said find a SAVY local lawyer with a vandetta against cops who do wrongful searches/seizures..

cops do make MISTAKES. in this case they made a mistake.

they should of rushed to see the judge and got a WARRANT then come back to his house and clean up

I'm no lawyer, but I think the real problem T1 faces now is that when the cops begain reading his wife her Miranda rights, he "took the blame" and probably admitted that the gear was his. That outcome, no doubt, is exactly what the cops had hoped for. They knew that the minute a stand-up husband saw his wife getting read her rights, he'd step in and condemn himself.

Very best of luck, bro. Next time they start reading your wife her rights, let your attorney handle it for you.

Well, the timeline makes it clear he did that not long after being found passed out and puking. I don't think he's responsible for anything he said under those conditions, especially he says they wanted to wait til his mind was clear to talk to him. Any decent lawyer will get that part thrown out.

Someone needs to start creating an online DB of all the evidence used in steroid busts so people can put their heads together and get guys off on technicalities.

As previously stated, do not talk until you have a good lawyer. Cops will tell you they are helping you, will go easy if you cooperate, etc. It sounds like there is a good ol' boy system where you live, so consider this- find a lawyer who lives in a different county or jurisdiction who can play hardball. Many lawyers are hesitant to piss in their own backyard, so to speak.

If his wife gave permission when the officers asked to "look around" then no warrant was necessary. Even if she didn't conceed to the cop, or he never asked; I'd bet it'll probably say they did in his report.
