...12pm. Kinda feel bad about it as I dont think my boss sees it coming, and hes a good guy. Its his boss I dont get along with.

Anyhoo, Ill be heading to happy hour afterwards and getting plastered off of Miller Lights with the coworkers, then I have all next week off before I start again on 2/1.

And Im pseudo-violating my non-compete by bringing my top 10 or so clients with me. Im sure my soon-to-be-old firm will be a bit upset.

In this industry they have security escort you out as soon as you give notice. They dont want you taking any client information.

Which doesnt make sense considering if Im quitting Ive probably know for at least a few days, and therefore would have had more than enough time to steal whatever I wanted.

A perfect example would be how I got commitment from a dozen of my clients over the past 2 days to keep their assets with me after I move.

Because I didn't technically ask them to come. I told them where I was going and stated that I couldn't ask them, but if they decided on their own I would love to work with them. I also have signed letters stating as much.

According to my agreement, however, simply informing them of my destination is a-o-k. I had a securities attorney confirm that as well.

I wonder if it's a non-competition or non-solicitation agreement. A lot of states nuke non-compete agreements unless some serious coin is involved (i.e. They pay him 100% salary to sit-out a couple years).
 
Youre a sneaky fucker bor, i hope your securities attorney knows his non-compete law.

It may technically be a non-solicitation. Either way all the smart folks tell me Im good.

Non-competes are essentially to scare people. The courts hate non-competes. I'm sure you're straight.

My company has tried and failed more than a couple times to enforce a non-compete agreement in Illinois. Doesn't go so well. Waste of time & money.

Went well. Boss was legit about it. Went out and got drunk off miller lights. Trying to drink enough water right now before bedtime.

I actually had my last PT boss threaten to sue me with a non-compete because I was taking all of his clients that knew he sucked. After I showed him my lawyers' letter stating that his piece of paper had enough holes in it to drive a dump truck through he backed down really quick. More often than not those things are as effective as a liability waiver.

Yup.

Non-competes where consideration is employment or continued employment are pretty much a joke. Unless you've got something that specifies a limited number of clients or a incredibly small geography, it will get knocked down.

Now do be careful... if you get a big signing bonus as consideration, your agreement may have teeth. If you receive highly specialized and costly training in exchange for signing an agreement, you may have a problem as well. And if someone buys your business (particularly if real $$$ is involved), that non-compete will be almost always enforcable. Finally, look out for any clauses where they can pay you a portion (i.e. 50%-100%) of your salary for up to a few years and force you to not compete. You'd be able to do something else while being paid off, but you probably can't compete with them then as well.
