Did he kill a man? Yes.
Did he do so unlawfully? Yes.
Hence, he murdered a man. Hell, all lexicography aside so that Puc won't be on my back, forget the definition of the word. He killed a man in cold blood and he deserves to either die for it, or spend the rest of his life in prison.
This sentence is only giving the American People the message that murder is excusable - much like I'm sure the Yates Butcher case will also show.
