Your friend should find him and arrange a major beating.
What the judge will do, is tough to say. He may issue a dui but softer penalties. the DA will not drop the charges and will ride it out until someone breaks or pleads. Either way, someone has to get it, or everyone will. They do the same thiung with drug charges btw. They'll yell at you then for letting a drunk idiot drive for you. Don't expect much sympathy.
