Tadalafil like sildenafil

Tadalafil like sildenafil was discovered years ago, so i presume Lilly has a 'use' patent on it and possibly one for a new synthesis method. As long as the tabs you have don't look like the real ones or come labelled as Cialis or claim to treat ED they might just be legal but still un-FDA approved. Then again your question wasn't were they legal in the USA.

This raises a good point...

Don't forget that drugs that are not approved by the FDA can and will fall under the category of "unapproved new drugs" which would make them illegal for possession or sale. Just because a drug is not specifically mentioned on a list of prohibited substances, does not mean that it's automatically legal.

Just to remind everyone... Notwithstanding the whole "research chemicals" thing, which has apparently facilitated the purchase and sale of substances (mostly non-controlled) that were formerly not as readily available. Possession of prescription drugs (FDA approved) without a prescription is illegal. The penalties vary by state and also under Federal law. You would be hard-pressed to create a "research chemicals" defense if you were found in possession of a few bottles of generic cialis.

Possession is a misdemeanor as is sales of uncontrolled script chems.

If it's not in script form as in 'pill' form which gets the 'research' category, then they would look at circumstantial evidence surrounding how you got it and what your job is and the like.

As for generic subverting the patent, I'd say YES, though the problem is the maker who would get the patentholder against them which is EXACTLY what happened with a viagra seller a few years back.

If you see GENERIC PILLS sold via script, then generic powder is fine, but until you do you are risking MORE because counterfeit buying and selling of script stuff like AS or HGH or viagra then becomes FRAUD and a FEDERAL felony!

So, by buying fake stuff or stuff subverting a patent, you just went from a misdemeanor of them seizing it and giving you a slap to the possibility of big time trouble.

the Viagra patent will expire in 2011. generic version are legally manufactured in India just because they don't recognize the US patent, but its of course illegal to ship them to the US or Europe.
