So I just recently moved to Cali. Long story short; I rarely drink but I went out tuesday with a girl and was driving her car back to her house which was like half a mile away and I managed to be pulled over for a headlight that was out and was arrested for a DUI. I blew a .089%. So appearantly DUI's are a big deal out here, I know I shouldn't have been driving but didn't think I was that intoxicated. Any advice as far as should I get a lawyer, no lawyer, plead guilty/not guilty etc? I'm not an alcoholic and it blows that the first time I drink in seven months results in something that sounds like will fuck my record for good. Advice?
1) It really is best to just do zero tolerance on drinking and driving. It's a great excuse to pass on booze at a restaurant and then drink like hell at her place (then of course, stay over).
2) You're close to the legal limit. A good (read: expensive) lawyer should help you a lot.
3) I like the harsh DUI laws. I like the harsh distracted driving (i.e. texting) laws. I do wish they'd also crack down on old/demented/clueless drivers just as harshly.
4) Radar traps bother me too. It seems hypocritical to me to setup a known traffic hazard in the name of catching people who drive hazardously.
