Mom avoids jail time
Pleads guilty to causing child's death, gets credit for time served in custody

A 23-year-old city woman who put her newborn baby into a garbage bag after going to bizarre lengths to conceal the pregnancy was handed a 90-day jail sentence yesterday.

However, a judge ruled Nicole Anderwald has already served the time with pretrial custody and she was put on probation for two years.

She will also be forced to have a pregnancy test every three months for the duration of her probation.

Court of Queen's Bench Justice Terry Clackson told Anderwald the concealment of her pregnancy from family, friends and co-workers was "reprehensible conduct" but said he is not trying to stop her from having a baby. "I'm just trying to ensure that if you do get pregnant, the world knows about it and steps can be taken to make sure you get the support you need," said Clackson.

Anderwald was originally charged with second-degree murder in the Aug. 9, 2004, death of her daughter - who Anderwald revealed yesterday was named Angela - but it was reduced to infanticide after a preliminary hearing.


On Oct. 7, she pleaded guilty to the lesser charges of causing the death of a baby by neglecting to obtain assistance in childbirth and disposing of the body of a child.

Clackson accepted Anderwald was suffering from a "disturbance of the mind" at the time of the birth.

"This is not a case of murder. This is not a case of manslaughter. It is not even a case of infanticide," he said.

"It is a case involving a loss of life," continued Clackson.

"I am not sentencing a violent killer, but a terrified woman who was hiding her child from the world."

Just before being sentenced, Anderwald stood in the prisoner's box and read out a prepared statement.

"Your honour, I would like to extend my apology to those who love me, my family, my friends and acquaintances. This has affected all of them and I am deeply sorry for that. Many still feel they failed me," she said quietly.

"I wish I could change the past and bring Angela back. Unfortunately, I cannot. For the rest of my life I will always wonder what she could have become and feel the pain of regret and loss. That is all I have to say. Thank you."

Court heard Anderwald went to bizarre lengths to conceal her pregnancy, telling relatives she was "just getting fat" and telling co-workers she was having an operation to remove a tumour "the size of a watermelon."

Anderwald secretly gave birth in her bedroom at the Mill Woods home of her mom and stepdad, and did not check on the welfare of the baby girl or call for assistance.

After passing out for several hours, she put the baby in a garbage bag and put it beside her bed.

Then she had a bath and returned to her room and watched TV.

The next day she put the garbage bag in her closet and went to work. Co-workers reported she was happy and told them an operation to remove a tumour was successful.

After her mother discovered the garbage bag, she called police and Anderwald was arrested at her work.
