case law
thats why there are lawyers....there are more volumes of case law than LAWS themselves.....case laws dictate situations percisely....state of mind, and a plethora of other criteria....sentencing is up to judges-and in our crowded judicial system and over-crowded institutions- time served is usually cut in half...especially in california.....under the circumstances stated in the above case, it is unlikely that this man (husband) would go out and kill again....therefor the judge probably took this into consideration and gave a light sentence...after all- he THOUGHT his wife was a victim...doesnt make it ok-or right- but if it had been you or I???? the system would have worked in our favor....still, he has to live with the incident...and dont think for a minute that he got everything for free.........crew9 said:
How on earth did he get out of jail so quickly? That was a crime of passion, murder 2 is it not?
