i'm getting sued

the sheriff's department just dropped off a snotice and summons from my old roomates.

sweet.
 
i already had my entire argument outlined before this, but it is still a bit disconcerting to be sued.

wow, your roomates are assholes. I hope you can get them into some trouble still.
is there any way you can prove to the authorities that illegal activities were occuring in there? that would be a good way to get them back.

anyway, i feel for you, it sucks that they are actually trying to sue, because they have no case, and now this is just an extra hassle on your hand to deal with, and possibly an extra expense (if you need to hire a lawyer)
 
Yeah... bro... I've been sued several times for things that I had no real liability for, none-the-less it is a headache.

Hell.. right now I am involved in a legal dispute that completely sucks and they are just trying to bend me over - they know they are wrong, but they smell a little blood.

And for god's fucking sake... I hope to god you got those bitches on tape partying their asses off, smoking marijauana.. and the other living conditions you lived in. Tell me you did. Say it.

Now... make a good citizen's move and fill out a police report regarding said activity. Nothing will happen of it, but you take that report with you to court.

I would imagine this is small claims?

The judge will laugh and throw it out. Make sure to make a counter claim for your last months rent based on the fact that YOU WERE FORCED TO MOVE OUT DUE TO THE LIVING CONDITIONS!

Sure you can. Plus you want last month's rent due to the fact your space was unusable, and you want damages for having been forced to move during the emergency situation.
 
You can file a small claims case without an attorney. Your local court house will have the paperwork available. You fill it out and pay a small fee.

Oh...and while I hate rats...go file a complaint with your local law enforcement about their little stash. Fuck them since they are trying to fuck you.

but Judges are not dumb either, just tell the truth and they wil be able to pick up on lies

the fact you lived their so short amount a time shoudl be a good mark in your favor
 
Well, I missed the backstory on what all happened to you. Zap me a PM, and I will give you some thoughts. I can only say how it was in Kentucky, since that is the only state in which I'm licensed.

The people on here have the right idea about countersuits in general, though. They are great leverage, so long as the countersuit has merit.
 
ok, i have this thing pretty well mapped out. i will post up for you guys, but i can't at this moment, since i have to be at a restaurant in > 15 minutes.

i think i have an extremely tight case here, even with there being no written lease or contract.

Yes you can file a small claim without a lawyer. Also check into it and see if there is any type of free representation in your surrounding area for housing courts...Did you sign any thing with you moved in? Even so much as a tenant at will?
It is not that complicated and you will most likely walk away with a huge smile on your face. Fact is that it was basically a rooming home type of dwelling. Is the actual owner of the house going after you? If it is just roomates then I am sure that it will be dismissed in no time flat.
 
write out your defense and read it to the judge. halfway through, he'll want to kill himself.

bro, first they have to PROVE you owe them money. And without a contract, there is no evidence of whatever you agreed upon.

They'll probaly want money. He doesn't owe them any. I know it's a pain in the ass but hopefully being put in place in court will shut them up.

With all that shit you posted up about the different laws they were breaking
they are fucking idiots to even attempt this. I wonder if they even looked
any of that stuff up? Own the shit outta them.
