Do I Have A Law Suit?

Anesthesia is supposed to knock you out. Not leave you semi-conscious. Accordingly, I doubt that the reasonable standard of care was met, in this particular instance.

I'd like to modify what I said about mental anguish. While it IS hard to prove, what you suffered in this instance was PHYSICAL pain. All you have to do is allege it. Then it becomes a matter of credibility for the jury to decide, should this case not settle out of court.
 
Dude, See if they will settle with ya before you get a scumsucking lawyer. They will want 33% of a settlement and 40% if they have to actually work and go to court. The hospital knows this too make em an offer based on saviing the lawyer commission.

Secondly,

ALWAYS GET A GENERAL ANETHESIA!!! You go to sleep you wake up when it is over and that's it YOU FEEL NOTHING(except the pain when you wake up but then ask for more morphine.

Most PI lawyers get one third of any settlement, regardless of whether it's settled in court or out of court.

Could one sue because it was not supposed to hurt???

Flexed there is a very easy way to test the water whether or not you have a case. Simply call a litigation attorney, describe your case to him over the phone, and ask him if he will take the case on contingency (i.e., he only gets paid if he wins.)

My suspicion is every attorney you ask will tell you you don't have much of a case, and they won't want to take it unless they are paid upfront.

I personally tried this to evaluate a lawsuit 4 years ago. I didn't know how strong my contract case really was... so I met with an attorney... laid it all out for him... and told him I was currently in three other lawsuits and could not finance this case. He told me he was not only willing to take it on contingency... he was also willing to back it for recovery (i.e., actually collecting the money if you win.) I knew then that I had a winner. Lawyers will ONLY take cases on contingency they consider a sure win with 100% collectability.

Sometimes you will be surprised. I was then.

True... but a filling is quite different from an operation where they cut you open.

yes--maybe but my guess is in a lawsuit where he has no physical injuries--but just that fact that he may or may not have felt pain, is the same as having your tooth filled....Walk away injury free saying what the fuck did he do to me(but nothing to prove-physically he did anything wrong)
 
Just alleging that he felt pain is enough to establish the element of phsyical injury.

Whether a jury believes that would be a different story.
