a ROBBERY is taking property or money using the threat of force or fear and having the ability to carry out that threat...ie: toy gun= is actually a robbery...

i was in a situation like that one evening with a GF on a mall....3 guys knocked over a Zales Jewelry store....major exchange of gunfire- cops had been tipped off and were waiting undercover...anyway. 3 bad guys got shot right in front of me and my GF. all 3 DOA....

I know, but what I should have done was follow the punk out the door and got a good description of him and a vehicle, plate #, etc...

I don't know, it's confusing to me right now, I do feel good about helping, but my priorities are way different now, since Porkchop is in my life.

I'll take ya shopping....Just don't try to steal anything, or I may have to take you down to china town too!

You reacted on your first instinct and that was to help.
This time you were ok, next time you will know to just follow the punk. Whether or not you had porkchop, following would have been wiser.

It's classified as a robbery because he did have the "gun" in his possesion/on his person and that he had it for this specific reason, wether he used it or not. It's up to his Atty. to argue the semantics, but I do know what you mean, he did bump his charges up to a felony because he had the toy gun.
