If the house is under both your names he can't sell it without you and if you agree to split the equity at the sale of the home then that would all go in the final divorce decree and you wouldn't sign a quit claim deed at the divorce it would sell and you'd split the equity and go your separate ways. You don't have to stay in the house for that nor do you absolutely need a lawyer for it I don't believe but I would get legal advice for sure because every state is different. If you move out and are divorcing it can be hard to move back in (I think) if you change your mind and he doesn't change his. But you don't want a War of the Roses scenario either lol
