Dating a contractor, I know that anyone doing work in public spaces has a set of requirements to ensure the safety of people not involved with your work as well as your own safety.
An un-marked hole in the pavement that was left unsupervised is a breach of that responsibility. What if she was blind? The same set of circumstances would have led her to fall - no one was there to warn her and nothing was put up to block off the area. Her being retarded doesn't change that fact. The responsibility of protecting the area lies with the workers, not her intelligence.
ps - I hate texting and I hate frivilous lawsuits. But nonetheless, she has a case.

God I hope she doesn't get some idiot judge who thinks she deserves anything for being stupid and unobservant. Rather make her an example of what NOT to do and publicly humiliate her by laughing in her face.
