Steroid.com sues EliteFitness again to Censor your Postings about RoidStore

Steroid.com/RoidStore and owner Brian Clapp intend to sue EliteFitness.com a second time in order to censor your postings where you shared with our community the ingredients in the RoidStore supplements and RoidStore's cost per bottle.

I attached copies of the temporary restraining order that Steroid.com/RoidStore d/b/a Dynamic Sports Nutrition obtained this morning and I will elaborate more on the situation shortly. I also attached the letter from Steroid.com's attorneys threatening to sue us again if the postings that list the RoidStore ingredients and manufacturing costs are not removed.

Both EliteFitness.com and Nelson Montana have been threatened with this lawsuit as I am sure many other sites have been.

Please know that there is nothing more upsetting to me than having Brian Clapp and his Steroid.com and RoidStore sites censoring your free speech on the forums. And I apologize in advance for having to edit some member posts.

You are encouraged to post here all links to the RoidStore ingredients and costs that appear on other sites that Brian Clapp has not been able to censor yet.

What a bunch of bullshit. Someone needs to sue them for fraud and market deception. Besides, all that was reported here was what someone else (AR) already brought up and publically disclosed.

I don't see where he has a leg to stand on, as long as EF removes the post he can't really sue for anything kind of money or damage as it wasn't the site that posted it it was someone that is only a member. This guy doesn't realize that its too late and its all over the net now and his business is basically done.

I was always suspicious of steroid.com and Brian Clapp's roid store... Never fell for his piece of $hit site, but it is a shame that he did manage to scam many people under the false guise of "real gear"

i dont understand how he will win. first off its freedom of speech, and were protecting people from false advertisement ( which u can sue for, and should be sued). also if he looses u should sue him for taking u to court. is he sueing AR for the one who originally posted it?. if hes not u can bring that up in court that he is out to get u.
its also not false information that we are providing, if it was a false it would be libel.

but it just doesnt make sense i cant see how he can sue u and expect to win

It is a huge mess, he has already sued EF once over a copyright issue. You can read about that in this article:

He has sued Anthony Roberts, his former employee, and Steroid-Rx.com over their posting the ingredients in the RoidStore supplements.

He has obtained a restraining order to censor members from reposting the ingredients and costs of manufacturing.

You know...we all know the truth. Hell, half the web knows it already as well so, in that respect, although I agree its complete and utter bullshit, I can see how just pulling the posts might just be the easiest thing to do. Why go through all the crap of a long litigation process when, like I said, most everyone already knows the truth. Isn't that what really matters anyway?

under the digital m copyright act the service provider can be liable if they keep the site up---although i am sure you know that i say it just so everyone knows that it is very easy to muzzle another's First Amendment rights--at least until the prelim inj hearing-- you guys need to get these cases removed to federal court and get the judicial panel for multi-district litigation to take the cases so they die a slow death.

Yup, unbelievable.

The server provider must be a complete spineless wimp. I hope they get a new provider and ditch whoever it was. I was up until recently a member of s.com. They have been doing a very poor job of running their community, causing a lot of uproar over AR and banning members who mentioned other boards (such as steroid-rx or elitefitness). Generally very poor business practices, but I think they have a large clientèle so they get by on that. Brian Clapp doen't foster respect for community members, instead his interests lie in finding newbs to take advantage of with his scammer site, roidstore.com. Anyone knowledgeable knows the roidstore is a joke. There's also a mod there named Carlos_E who basically runs the site for Brian, he starts political threads then bans people who argue with him. He has a chip on his shoulder against 'hetero's' and has been discreetly banning people when he gets his panties in a bunch. If someone argues against his whacko political beliefs Carlos throws a hissy fit and bans them.

Would agree

In litigation then its usually guilty until proven innocent as the claiment puts their case together to get an immediate injunction i.e. site taken down to stop further damages being caused. If the case has been put forward then all involved no matter what proof or sense will have to answer the case which means most go into defensive mode i..e. hosting companies so they are not liable.

Obviously if those sites are not found guilty they can claim damages back but thats after the case has been heard and then awarded which does not help now

No matter who is right or wrong the cost of the whole case will be through the roof to achieve what? Basically if AR and the other co defendants do not have the finances to fight the litigation how is he going to pay damages (if they can be proved)?

The claimant must be very determined to prevent the information the defendants have remaining in the public domain.

Well that is enough to certainly hinder your sleep!

I guess the claimant would have to prove they have or potentially could suffer that amount of loss but certainly a starting point for negotiations.

How is Elite getting on has there been an amicable solution negotiated?

I know one thing i would not like to be picking up BC's legal bills every month with the amount of writs he has on the go!

Not sure but would suspect the sealing of the original injunction and a court date set. Between now and the court date there will need to be disclosure, skeleton arguments etc and then a hearing. There will also probably be sometime set aside for mediation before the hearing date (if litigation law is similar to UK)

What astounds me is what the claimant hopes to gain / achieve apart from proving a point (an expensive one at that). Its obvious the defendants do not have the money to defend let alone pay damages so all that the claiment will achive is a very big legal bill and the satisfaction that the defendents lost

Not the best commercial decision at all as all it does is bring more attention to his business which i would have thought it had been better for him to keep it out of the media

Seems emotions are running the case which only means one thing - lots of revenue for lawyers
