She's not getting more jail time than anyone else! People assume this because the offense was "Driving with suspended license".

It is not. Here's how it goes.

At the DUI sentencing, she is sentenced to 45 days in jail. BUT, this jail time is SUSPENDED, and replaced with probation time.

During this probation period, if she gets any unlawful offenses, the SUSPENDED 45 days in jail for the DUI GO INTO EFFECT.

In other words, as long as she stays out of trouble during her probation period, she will never have to actually sit the 45 days in jail she was sentenced to for her DUI.

So thats where the 45 days of jail come in.

Well I am just relaying what I heard from Americsn lawyers on CNN........and i am pretty sure they know the law

here is something interesting

Dog and Beth to Paris Haters -- You're Full of It!
Posted Jun 8th 2007 10:33AM by TMZ Staff
You might think that Dog and Beth Chapman -- the toughest, hardest bounty hunters around -- might take a tough stance against Paris Hilton's early release. Think again!
I
The Chapmans, who spoke exclusively to TMZ late last night, have both spent a little time in jails themselves and think that Paris has already been punished enough for what they call a "traffic offense" -- and they have just one question for all those outraged observers: Have you ever spent even an hour in jail?

Dog, star of A&E's "Dog the Bounty Hunter," says he gave serious thought to making a very unusual plea to the judge in Paris' case after hearing of the 45-day sentence. "I was going to offer to do the 45 days for her," he says. "And if anyone hates jail, my brother, it's Dog Chapman." Dog's prescription for punishing Paris? Putting Paris under "Dog Arrest" and having Beth give Paris a stern talking-to about drinking, driving and life.

Beth tells us that in her 20 years in the bail bonds biz, she's never seen anyone who committed Paris' crime -- which she calls essentially a "traffic offense" -- get such a stiff sentence. "That L.A. City Attorney [Rocky Delgadillo] is a joke. Three days in isolation for a person like Paris is more than enough. What you can't do is waste taxpayer money so a bunch of people can get their rocks off."

lawyers know the law, yes.. they know exactly how to twist it to benefit who they want it to benefit.. I don't give a shit what the lawyers say..

It's how California works.. they have the 3 strike rule and she got her 3 strikes in 3 months.. she's stupid for doing it w/ the media attention she gets

plus she didn't get the most forgiving judge so she got what she deserved IMO

Well, I'm pretty sure the judge in this case, as well as the prosecuting attorney know the law, also (Dog and Beth Chapman certainly don't, as seen in that article!), which is why they are outraged by the sheriffs move, hauling Paris back to court, and considering charging the sheriff with contempt of court.

The sheriff should be charged. The sheriff is part of the "executive branch" of the law. He cannot make decisions about how someone's sentence should be played out. In this case, he decided that an inmate could do home detention despite what the judge ordered. Normally, in order for an inmate to go from jail to home detention they must get that approved as a stipulation of their sentence. Their attorney may suggest it, the prosecuting attorney may or may not suggest it. But the judge himself decides whether or not someone is granted home detention.

A sheriff where the inmate is jailed does not have the authority to grant home detention. That would be an example of a member of the "executive branch" of the law crossing the line into the "judicial branch" of the law. And the Constitution makes sure this does not happen, because it otherwise would grant too much power to a single entity.

Paris Hilton has been ordered back to jail in Lynwood and will serve out her 23 day sentence with a credit for the 5 days she's already served. Reporters say she was crying through the entire process and, when the judge gave his decision, she let out a huge cry and said, "This isn't right." She was then physically dragged out of the courtroom by a female deputy, in tears, screaming, "Mom, Mom, Mom."

Some witnesses say they saw a rainbow beaming directly into the courtroom. And others say they saw a giant man in the clouds with a white beard nodding his head approvingly. I just don't know who to believe anymore. It just all sounds so right.

it sucks that miserable people with no lives or clue of how the detention system works wanna see a person posing little to zero threat to society suffer so much just cause she's a baller

Re: Paris Hilton is going back to Jail and the Sheriff that let her out is being held

does she deserve to be in jail? yes

would I do her in the ass? hell yes

if i was a guard in her area i'd catch video footage on my cellphone of her chillen in her cell.. or even some pics of her in her cell..

those pics/video would easily sell to magazines for well over a million

i hope she fucking kills herself ... lol and her dumb dog eats some posion dog food
