New Police Tactic? Bros Read This!

Do you have a cordless phone??? I don't know about the newer models, but some of the older ones would dial 911 when the batteries ran low for some reason.
 
half of you are way off on your posts regarding the 911 call and settlement.

Mr. X was basing his premise on the fact that 911 WAS NOT ACTUALLY CALLED. so yes, of course if 911 was called there would be case. and probably even if 911 wasn't called, the cops would just say the dispatcher gave the wrong address or they accidently responded to the wrong address and at that point you would have to prove intent on the cops to make up a reason to search your house (i.e. the landlord suspects you of shit, has a good friend that's a cop and owes him a favor - or something like that)..

but then if you could prove that there was NO 911 call, and there wasn't even a 911 call regarding a similar address, and the cops made up the 911 thing for the landlord or the landlord made up the 911 thing for the cops (ooohh - that could be it - doesn't your manager have a key to your apt?) with the intent of catching with something else - THEN YOU WOULD HAVE A LAWSUIT.

What to do, what to do......

Bro..... let it ride for now but consider two things.
First, if they did come and see some gear, they would have to leave the premises and go and obtain one to be able to do a legal search and still have it hold up in a courtroom.
Second, consider it fortunate that they found nothing because if they did, they would most likely, depending on the amount found or seen, would have "reasonable cause" to monitor your residence 24/7 just to see the what interaction takes place at your home.
One thing that you could do is get trace on the call and see that it doesn't occur for a second time... that maybe an option for you.... here in Canada things are done just a tad different... the buggers make up laws to justify their actions of "search and seizure".... the catch phrase is "probable cause" it covers a bunch of bases for them as well as covering their assets.... if you know what I mean.

No, they would not have to leave it. They found it and now they are by law allowed to search for more fruits of the crime.

If they believe it may lead to something bigger then they would get a warrant, just to cover their assess.

Let's talk about, reasonable search and seizure.

If I find something in plain view (there are no reasonable expectations of privacy) then I can continue to look for more fruits of the crime, arrest you, search you and on.

Again I could go on for a long time. I'll post a biggy all about search and seizure and so on. Seen as how I was a Deputy Sheriff and all and have a pretty good working knowledge of this.

I completely agree with chesty on this one. It sounds as if they did their job. I, for one, am relieved to know should I dial 911 and am not able to speak that someone will check up on me. Amidst all of this talk about how it's "bullshit" and they are trying to bust you illegally, we seem to be forgetting that buying, selling and possesing anabolics without a prescription is a FELONY. If you have it, you ARE breaking the law. Don't get me wrong...I think the shit should be legal too, but this is the way it is. Ultimately, if they entered your house to respond to a 911 call (bogus or otherwise) they have no right or reason to search your home for ANYTHING illegal. If it's sitting on your kitchen table however...

Get a record of calls made from your home from the phone company. If there were no 911 calls made on the date in question, then you have every right (and SHOULD) sue for everything MR.X said and then some.

If there indeed WAS a 911 call made on that date, then as chesty said, they police were doing their job. If there was a call made, then they were in there looking for you to help you if something was wrong. As you said, they didn't find anything and it doesn't appear that they searched, so if they were there with a good reason (i.e. 911 somehow called), then leave it alone and be happy that you have some responsible police in your area.
