Is it illegal to refer someone to a source?

If you are openly getting money/payments of some source for referring you are a part of the source if hey wanted to they could bust you, the source and anyone involved! Read the RICO statutes!

You dont even have to get paid. You can be arrested for giving drugs away.
 
Word Alone

Most laws in the United States require more then just words alone. Action must also go hand in hand. Therefore, by telling someone that a source is here, i dont think your aiding and abbetting.
 
Talk to Craig Titus about weather or not the Feds can pin a drug charge on you for just introducing two people..buyer/seller. It's "Conspiracy" and the charges for this are SO far reaching that they sure as hell could make you part of one if you were involved in any way, if they really wanted to. Make no mistake.

No, it's not different at all. There is a HUGE difference between you telling someone, "hey, Mischief is selling Test Cyp this week", than it is to come over to my house, pick it up, and deliver it to someone else. VERY different. I have read the RICO statutes. If the "runners" you know are in jail, it's not just for telling someone that you know of someone else who is breaking the law (then they wouldn't be "runners", they'd be "whisperers"). That is NOT active enough involvement.

It's not like child molestation statutes, where some people are forced with a mandatory duty to disclose info to authorities. If you know a dealer, big deal, and you can SAY whatever you want about it, just don't ever receive any benefit for doing so, THEN you are in trouble.

1st offense. & the rico act was set up for the MOB !!!!!!!!!!!!!!!!!!
 
As any lawyer will tell you, "It depends." In general, I would think that it is safe to say that it is illegal.

Depending on your state's penal law, you could be charged with acting-in-concert with the steroid seller. In New York, "When one person engages in conduct which constitutes an offense, another person is criminally liable for such conduct when, acting with the mental culpability required for the commission thereof, he solicits, requests, commands, importunes, or intentionally aids such person to engage in such conduct." So by referring someone to a seller, you are equally culpable under the law.

I don't practice in federal court, but I'd posit that any AUSA worth his/her salt could obtain a conviction for you for conspiracy. Conspiracy is the easiest crime in the world to prove.

Now, I say "it depends," because every case is fact specific. There are factual scenarios where someone may not be found guilty of conspiring or acting-in-concert. For instance, New York has a defense called "agency." Agency basically means that you were just helping a buyer to obtain drugs; you were the agent of the buyer. The flip-side of agency is being a steerer; you are the agent of the seller. The line dividing agency from steering is a very fine line, and many defendants find themselves on the wrong side.

So you should be aware that you could be charged with a crime just for referring someone to a seller.

No, thank you for posting as these types of threads need someone that truely knows what they're talking about, and doesn't just learn about the crimminal justice system from TV shows.
