After that, J.S.R. — who cannot be named because he was 17 when Creba was shot and killed — would serve the remaining three years of his sentence in the community, albeit under conditional supervision, Kerry Hughes said today.

Hughes argued that J.S.R., who was only 38 days from adulthood when he took part in a gun battle that killed the 15-year-old Riverdale Collegiate student, should be sentenced as an adult.

If so, the 21-year-old man would get an automatic life sentence and would have to serve three years and nine months before he is eligible to apply for parole, Hughes told Justice Ian Nordheimer today.
