I was charges with resisting arrest in my home I was in a fight and the cops where called they beat me dislocated my arm but I was on xanax and dont remember I;m also charged with possesing a weapon I did not threaten anyone or try to use it just possesing also criminal mischief I got bailed out today and go to court tommorww what do u think can happen, I dont even know what to say in court due to the fact I was blacked out

For 3 years I was an "expert witness" (I was a Social Worker) in divorces and child custody cases. Mostly boring but sometimes fun! Much as you describe. Yep, I got paid $60/hr....1990 dollars even when I just sat around all day and didn't testify (about 75% of the time). I had a 12 hour minimum per day. Often the case was over before lunch!

Anyway, blacking out with xzanny's is not a defense. You need a lawyer. If you can't afford one go to the PD's (Public Defender's) office ASAP. If you are a prior felon and you got caught with a weapon you are in double doo-doo.

Also, domestic abuse (if you get charged with it) precludes you from being able to use a weapon in the military and they will discharge you. When I was active duty there were quite a few guys that got booted - dishonorable discharge too.

I would start by growing up. Next I would get a different spouse or girlfriend and then a good lawyer. I thought you were going to Iraq, well this will help if you were going outside to look for your wife, yielding a knife. It could be a form of spousal abuse, in which you won't be able to be around guns or ammo for the rest of your life, if your convicted of domestic abuse.

lots of things facter in when going to a court house to make a deal.

1.most important "who is the judge on the bench that you are placed in frunt of.
different judge's mean different out comes its the facts.
2.when you bail out of jail who was it that gave you the bail.if it was a clerk magistrate or a clerk magistrate assistant then you're in good shape.the judge and the court trust his judgment and all most never over terns it and holds you on your arraignment.witch gives you more power.every one knows you can make a better deal when you're not in cuffs then you can when you're not.BUT if it was just a bail bondsman you could be fucked and the judge might hold you on a higher bail as soon as he stand in front of him.again depends on the judge and your lawyer.some lawyers have more pull with other judges and less with others.
3.what district are you in.different counties view crimes worse or better then others.I.e in my county there is a judge who's daughter died from a drunk driver.go in front of him for even a first offense and you could be looking at 2 1/2 years mando.
4.what d.a gets your case.fore a case like this you want to get a older veteran type d.a they got bigger and better things to do and they will see this crime as petty.get a new d.a and they will be dieing to make a case out of you no matter what your crime is.
5.what exactly is on your record.if it is really long then its still no big deal.but if you have the exact same tipe of crime "I.e you have 2 assalts and you get one more or you have 2 b@e and you get another you are pritty much fucked"
but not if you get a assalt then get a wepons charge and a disordly and a resisting areast.its not that good but its not that bad eather.

I got called back from the inactive resrve to a army reserve unit, and we are on alert to be deployed in June still hopeing not though

when I got in I had 7 driveing infractoins so many that I had to driveing retaning school,b@e 2 of them,home invaitoin,2 asalts,drug charges,2 leaveing the seen of a acsadint and I was on trile for a 3rd one when they took me in and got thous charges dropped fore me.
I was allso takeing aas when I took the drug test.
because I scored a 90% on the asvab or for some other reason they got me all the waivers I needed and got me in.
I just talked to a recruter the other day and he said even with me new charges they can still get me back in they just have to get me a "medical waiver fore my medical problums"witch is a hard wiaver to get.

there is one thing I know they cant get a waiver fore and that is if you are on probation then they cant take you in.its a new law passed by congress.so if he gets probation they have to let him go because when on probation he cant leave his home state for more then 24 hours.the only service that can take you well you are on probation is the navy because the navy is the only service that has there own probation department.so they will take over your probation contract.

1.major drug trafficing.as in state to state drug trafficing
2.rape or other sex offender
3.all charges that involve a "deadly weppon"need a waiver from a 3 star genral or higher and it cant be with in the last 3 years and you must right a letter of what happen why you feel you have bin reabilatated and blah blah blah to the genral for his aproval.and you must speek with him on the phone or in person at least once before waver aprovel.
4.just reamember the army is pretty high on the power chart they can do just about anything they want with in the law and some times above it.its all up to them.if they need people they will take what they can get.
5.not so long ago the courts used to sentance people to go to the army instead of jail.its still not against the law to do that the army just stoped it because they wanted a better image.there is nothing stoping the army from takeing you but the army.its all up to them.the longer this war gos on the less people want to join so the lower the standers will go to get in.they have now lowerd the cut of score fore the asvab to 20% that means a compleet retard can get in if he wants to.
