I got an underage last nite, advice needesd

before you all ride me on it, just wanna say that it really wasn't my fault. i friend of mine(girl) was throwing a temper tantrum by our dorms when we got off the bus. she refused to walk home i dont even know what she was throwing a fit about. i told her shes really drunk and she needs to keep walking and a cop came up and asked if everythign was ok. i told the top ya things are fine we are gonna go back now and the cop started to walk away but the stupid girl started trashing the cop telling her she idn'dt have to say shit. then she cop took us inside to talk to us and the girl starts mouthing about how shes going places and you police are fucking losers and going nowhere in life. how shes in college and thye dont have a degree. long story short i was cooperative, blew a .15, and ended up with underage. the girl on the other hand ended up with 2 citation underage and public drunkenness and left in handcuffs cuz she was outta control.

so my question is, being that i was super cooperative and eveyrthing. is there any chance of me being found not guilty coming from any angle.... only angles i can see are that i was helping a friend was outta control get home and im not sure but the cop really had no reason to come up to us at all..... we werne't showing any signs of being drunk. also if i plead not guilty does anything worse happen to me.....


im thinking im screwed but even if i am guilty then the girl might pay my fines. stupid hoe

I would think your, erm, "friend" acting out as she was would constitute probable cause for the cop to approach you.....Can you just pay the ticket without going to court??

Young people throwing a fit @ cops seems to be the norm nowadays....I see it a lot... :rolleyes:

Hmm not sure what underaged means.. but the cop had his right to apporach u because the person you were with was talking shit about a cop..

being drunk in public is one thing

but u also cant yell prfanities at a cop which your friend did.. sometimes you are guilty by association

One of the things about my last university I really liked was that the first week or two of school, the police gave fake underage tickets as a warning to kids.

I don't know that much about the law, so I can't really help here.

Also, I'm surprised she didn't ticketed for: resisting arrest, terroristic threatening and you for possible conspiracy, etc.....sometimes cops like to pile on the charges...

Pay the ticket, move on & find new friends who can hold their liquor better....

pennsylvania is gay, its a 300 dollar fine, 3 month drivers license suspension (please tell me how this is related to drinking at all), and an alcohol class i think. Im not realy sure why i even stopped to help the girl, me and her never get a long cuz i know shes the type to cause this shit

I think here in DE - it's suspended 1 year or until you turn 21....forget now which.....3 months is nothing....

.15 is pretty far over the .08 legal limit....and you're underage....

when i got caught with E (yea i had on me and i really cant complain that i got busted since i was a fucking moron and had controlled substance on me ) just delt with

1. go to court
2. say your guilty
3. comm service, court fees etc
4. 1 year good behavior and they take off your record

In Wisconsin, an underage drinking ticket means you pay around $200 or so. That's it.

Now I see why you're asking about getting out of it.

Maybe go to www.xoxohth.com and ask them, there's a lot of PSU and UPenn guys there. They might have a better idea than us, as they're a college board and stuff.

now that we got that done with, they have an underage offenders program where it will be off my record and i save like 60 bucks at the cost of like 4 4 hour sessions of an alc class. i still doubt i can get out of it but who knows. and ya im from PA so i have a PA license and thats why its gonna be suspended. anyway just trying to save some money and some time. yes i know drinking underage is legal but its worth the risk. just sucks cuz im usually smart about it and i have definately been much drunker before and i hate this girl, i couldn't run becuz they were like on both sides of me and everything, plus this girl and me dont get along and she woulda ratted me out for sure. but ya, thanks for your help for those that were actually cool about it. and im really not sure why some of u are such cunts becuz i ask questions about MY LIFE. sorry taht MY LIFE DOES INVOLVE DRINKING/COLLEGE/HOOKING UP .

ps. i did hook up with a 17 year old and my friend hooked up with her 15 year old sister...... but we idnd't know they were young..... friends from home of the cunt that got me in trouble

At first I though you meant you had sex with a girl under the age of 18.

I was in a similar situation as yours once. I tried to talk her away from the police but when she started insulting them I let her go. They arrested her and I went home.

the thign was i tried to walk away and they wouldn't let me, so im going to say that had no reason to run up and withhold me. i have to go read the police report first to make sure im not missing something. if they ran up with no reason and did that it doesn;'t matter if i did something illlegal, they cant nail me for it.

Actually, here in DE (don't know if PA is similar but it might be cuz we're so close) walking whilst intoxicated IS illegal....so is riding a bike while intoxicated - it all falls under DUI.

And I *think* your "friend" mouthing off is considered probable cause & since you stayed - there was cause to check you too. Sucks that you got the guilt by association thing.

The reason they have for detaining you can be anything, most likely domestic dispute.

my neighbor has dealt with similar cases at this college and others. hes going to look at the police report and see what the cops wrote, he said he'll know from there... so i kinda do have a lawyer........ who knows just wish me luck and we'll see how it goes
