How would you handle this? Question of responsibility

So person A B C D are all sitting at a table.

Person A and B are fucking around with Person C, verbally abusing him, getting him riled up. Person A and B move towards person C threatening to smack him for talking back.

Person B ends up smacking person C on the back of the head, not a punch, a grazing slap that had a sting to it.

Person C retaliates against person A, he didn't know who smacked his head, so he swings on person A catches him in the eye.

Person A gets pissed, claimed he didn't slap person C.

Person C realizes that person B delivered the slap, and throws his beer on person B.

Person B is HOLDING Person D's digital Camera which gets soaked with beer.

Person D now wants their camera replaced.

Who should be financially responsible?
 
easy, person B.
they took responsibillity for the camera by agreeing to hold onto it.
or, in a more classless uncivil world, person D can eat a bag of dicks.

So the person who actually threw the beer doesn't have any responsibility for the damage it caused, I just want to make sure that is clear before I tell him to eat a dick!
 
I think owner of camera is shit out of luck because there is no legally binding agreement that states responsibility on anyone except owner to replace said camera. i.e. be responsible for your own shit and leave when people start getting stupid.

It's unknown how person B came into possesion of said camera? That's a potentially important detail.

Person C ruined the camera. It's his fault.

Person B should accept some responsibility as well and split it with person C.

Edit: Let me clarify, I go to a bar with some friends, we sit down I put my camera on the table, ask my friend to watch it then excuse myself to the bathroom. Two guys get into it near the bar, slam into our table, drinks are spilled on the camera.
are the two guys responsible? is the guy I asked to watch my camera responsible? are the people's whose drinks were spilled on my camera responsible?

Shit happens, I am responsible. It is my camera. period.

Shit happens. There was no intention to mess up the camera and there's no legally binding anything that places the responsibility in an enforceable way on anyone, further there was really no negligence on the holding person's part either. So its just tough shit. Shit happens. Plan ahead and don't hang around w/ people who are dumb enough to start a fight at a table w/ beer.
 
Here is how I see it.

Letter of the law, Camera owner D has no recourse.

BUT
we're all friends, it was NOT his fault.

Person C Chose to throw the beer, conscious decision, his actions led to the damage. he is responsible.

BUT

Person B provoked person C, so in the interest of friendship, they should share responsibility.

Persona A, I have a tough time assigning blame to, horseplay goes on all the time where no damage occurs, I guess the same logic could be used for person B.

As soon as the horseplay begun, the camera should have been returned to the owner. Respect for another man's property is a basic tenet of our society.

the story is, one person threw a beer on someone and damaged someone else's camera in the process.

We could retrace steps back through the entire day if needed, but I don't think it changes anything.

Utlimately the person who threw the beer rightly replaced the camera, he was the only one who lost composure in the group, everyone else was fucking around, the head slap was a bit much, but that doesn't give anyone excuse to damage property, period.

From a legal standpoint:

A and B committed assault. The destruction of the camera was proximately caused by their conduct. Thus, they are liable for the camera.

B is also liable for battery. And the destruction of the camera was proximately caused by his conduct so this reinforces he is liable.

BUT...

C retaliated against B and A. C's only defense could be self-defense which may apply to him hitting A in the eye but most likely this defense would not be upheld. Furthermore, the throwing of the beer by C was retaliatory and subsequently there would not be any defense he could raise. Additionally, C's conduct was the actual and proximate cause of the damage to the camera. Furthermore, his conduct was a supervening event which would cut-off A and B's liability.

In sum, C is liable for the damage to the camera.

It was found that his actions were pre meditated, un warrented (as was the slap that hit him, but two wrongs don't equal a right) and only a fool would throw a beer on someone holding a camera unless they intended to damage the camera.

Whether or not he intended to damage the camera is not an issue. The issue is whether he intended to dump beer on the other person. He intended to do that, thus he should be liable for all damages that foreseeably arise from his conduct.

For example if he started to pour the beer but the glass slipped and smacked the other person in the eye and they lost their eye there isn't a court in this nation that wouldn't hold that person responsible for their conduct. People need to recognize their conduct can have unintended consequences and that they will be, and should be, held accountable. :heart:

A beer being consciously thrown by person C in response to a slap from person B does not contitute unitended consequences. Had person B been holding the beer and lost control of it because of the slap, then yes, that would be an unintended consequence of person B's action, however in this case, Person C thought about his actions before consciously deciding to carry them out.

Imagine the person a table over saw person B slap person C and was so overcome with emotion, he slapped the woman across from him. Would that be considered a consquence of Person B who should then be held liable?

But buying a camera is a small price to pay, to learn who your true friends are... or aren't. Person C doesn't need friends like that. $200 is a great fee for that lesson. A. B, D, AND YOU for watching it happen. Fuck you all! Life's too short to stress like that.
