I'm almost 30 years old, married, and have a child of my own, so trust me when I say I know plenty about the how the world works. 5 of my very close friends have gone through divorce and only one has received a fair shake in court.

Example #1 - My friend Matt, married for 6 years to a bitch of a woman who ended up cheating on him. They had zero kids and he worked full time, she stayed home, and they rented a house together. In the divorce settlement this is what she got:

1) His 1999 M5 BMW
2) $1300.00 per month living expenses until she gets married
3) More than half of the household goods, all of which she did not come into the relationship with.

Now, you tell me how fair that is? Also, think twice before you accuse someone of not knowing what they are talking about, you are only making yourself look ignorant when they actually do. But hey, this is a fitness board so who cares anyway right?

For every situation like that there is one that is the exact opposite. Example: My friend J, married 12 years, worked most of that time, two children that she stayed home with at husbands request but worked from home as an accountant.
She got a house that needed repair, the Expedition, $100,000 mutual fund, child support based on his income of $45000 per year.
He got
the 5000 square foot home with private orchard and fishing pond on the golf course
3 new vehicles
the boat
the jet skis
the 4 wheelers
all the household contents
numerous mutual funds
two businesses (that were started after the marriage)
his stock in three family held corporations
15 rental properties
the Harley

The deal he offered her was "leave MY money alone and I won't fight you for custody of the kids".
It wasn't a totally bad deal, though. He pissed her off so bad that she is back in school and within the next 4 years he will have to refer to her as DOCTOR J.

No offense, you have no idea what you are talking about.

The reason the courts came up with equitable distribution is so that there would be less litigation so the divorces would cost less to BOTH PARTIES and it would be "more fair". Problem is when you have unscrupulous attorneys who LIE to their clients about what equitable distribution means.

It means THE MAN will get no more than half the assets and THE WOMAN will get NO LESS than half the debt.

If there are no children involved it is cut and dry. Both parties can jump up and down and yell and scream all they want. It will only squander BOTH of thier money and make the attorneys all the richer.

When there are children involved the only true victims are the children as money IS SQUANDERED ON STUPID SHIT THAT WON'T AMOUNT TO A HILL OF BEANS WHEN THE SUN SETS.... BUT IT IS MONEY THAT THE CHILDREN WILL MOST DEFINITELY MISS!

I think the children will miss their parents being together the most. I think the children will miss mom and dad and themselves as a whole family instead of children being shuffled between divorced parents. Ive never heard a child say "where did all of the money go mommy?"

I have no problem with women getting half of everything. Women pull at least half the weight, so they are entitled to half the assets. What I do think is wrong is when a woman cheats, and she still gets half of everything. In my opinion, if you go outside the marriage, you forfeit all rights to your half. You should still get some, but not 50%.

Nope, in most states, (proof of, or admission of )extra-marital affairs mean that the spouse FORFEITS their claim to any post seperation support (alimony) This does not effect child support.

I have first hand experience in this matter.

If you suspect extra marital activity, either hire a private detective, or have people lined up to testify, and / or have your soon to be ex declare it in their deposition....

I think most people treat their divorce proceedings lightly, when they should prepare for it as they would any legal proceeding. Have facts, make a case, make sure your own behavior is in order.

Make sure that, if you are considering seperation, etc... that YOU SEE AN ATTORNEY BEFORE you need one. Get counseling as to the laws of your state, and use that to create a strategy to govern your actions during the seperation / divorce.

Doing otherwise, you deserve what you get....
