Guys, you can drop the legallity issues if he is in Texas. The laws on age of consent (I have Texas State lawbooks for those who are curious how I know) in Texas state that the age of consent is 17. If she is under 17, and the guy is no more than 3 years older, and not a minor himself (example she is 16 and he is 19), that can be used as a deterant to prosecution in court, despite he being under aged.

That seems a sensible sort of law, on the face of it - there's a big social difference, for example, between a 17-year-old guy fucking his 16-year-old girlfriend and the same girl being fucked by her 45-year-old teacher or family friend or whatever.
