Grrrrrrrrrrr!!!!!!! Rant!! I'm seriously PO'd!!!

A couple weeks ago, it snowed here -- about 1 foot. Here in DE, a couple inches of snow shuts the state down. Well, the day it snowed some A$$ drives up the street & sideswipes my truck. Now I find out today he has no insurance, so I'm stuck paying the deductible to get it fixed!!

All in all, it's only $250, but it's the principle. MF'er is out driving around with no F'n insurance!! He already got cited for leaving the scene & inattentive driving...... well I left a message for the cop who'll now cite him for no insurance. Hope he has a warrant put out for him..... Jerk!!
 
Definitely take him to court. If he can't afford to pay the damages outright you can take possession of his car and sell it to make up the differences.

1) Won't the hassle (mine) & costs (mine) + the deductible make it not worthwhile?? I mean they can rule for me, but will I ever see the money?? Prolly not, so why bother??

2) It wasn't his car -- it was his parents apparantly cuz he's the driver & the name on the insurance were other names, same last name, different people...
 
go after his parents then,they shouldnt have let a uninsured driver take their car,you will win and there will be no costs to you as you can sue for court fees also, and they have to pay or it will come off there cheque when they get paid at work
 
OH, if the car is insured that is all that matters. Whoever's car it was has to take responsibilty because they allowed him to drive it. At least it is this way in Colorado. The owner of the car is responsible for the activities of that car and their insurance should pay the bills.

If you get a ruling in your favor then the other person can become liable for your legal bills. Now if the person is destitute and has no way of paying you then you are screwed.

I left a message for the cop & my insurance adjuster to see what my ins. co. says about getting my $$$ back.....since I have uninsured motorist protection, maybe they can do something...

And Oak -- the car is owned & insured by his parents -- their policy was cancelled in November '04....
 
His parents insurance would have to cover it.

If you claim it & pay the deductible, your premiums will go up. Not right away, but when it's time for renewal

In NY you can't get the car registered without an insurance card.
If his parents own the car and have it insured under whomever's name than that enitity's insurance is responsible.

There's a new scam out here for all the illegals since the SS card requirement has gone into effect at the DMV. Someone is sending out IL plates w/ stickers for these assholes to use so they can drive around and work (also illegally). They buy used cars and get these bogus plates and drive around out here and when they get into an accident they either drive off, bail and leave the car or say no habla, not my car and refuse to talk.

ah ic what you mean,and in that case its their responsiblity aswell as they allowed a vehicle to move thats uninsured.

That's the same way in SC. They use to get by using the temp. paper tag, the dealer issued when selling the car, good for 30 days, but they drive with it until a cop stops them. The dealer is suppose to make sure they are insured, but most of the time they just pencil in some bogus information, and then deny everything.
 
Your Insurance Company should sue them to recapture the money they
are spending to fix your vehicle, including your deductible..

Sorry hun, basically that is what UM coverage is for... Unless you want to pursue the small claims court suggestion (and there is No guar. they, him or his parents will pay even if you win).

It's unfortunate but I see this daily with my job

wow, what a dick. If you drive around without insurrance, you should be willing to help pay the other persons costs when you get into an accident.

If you file an uninsured motorist claim, you better believe your insurance company will do everything they can to collect from the party in question. You won't hear about it, they'll just pay your claim right away, but their legal department will pursue the perpetrator.

I'm going to call DMV & see if they can do anything + the insurance commissioner + see if the cop will put out a warrant on his Drivers license.....

That shit is rampant here in Texas....there's a shitload of Mexicans who don't have insurance, they'll just take off..the car is not in their name anyway.
