Ack...Fuck Me...DUI

Never expect to get a DUI, get a public defender, get plea bargained to nothing or get it thrown out or win in a trial. It never works that way - DUI's are ALL about money (from the lawyer, to the fines, to the scam classes that are run by relatives of court/politician officials) - and if you think you can work the system and pay no money - you're gonna get owned. If you truly have NO money (welfare reject, no job) - expect them to throw ou in jail for awhile. When it comes to courts - MONEY talks. Ever wonder why everyone always says "Get a lawyer". Lawyers LOVE heraing that. It's $$ to their ears :)

Public Defender is the fastest way to enjoy the jail system. Hence why most prisoners come from poor backgrounds.

I'm gonna go out on a limb and say there are more sober drivers on the road than drunks. Skewed statistics anyone?

most counties don't have the money for a Public Defender, they appoint lawyers that work in that court. They do appoint the youger attorneys to get them experience, but not always. As I said in my other post, depending on the DA, if you will take a plea and get the hell off thier workload, they'll usually cut some good deals, new attorney or old established ones. What I see in almost every court, they have a standard offer for any offense ( that varies because of previous criminal history and other circumstances), most are really lienient to keep from dealing with the case more than once. The quicker that they can get you to agree to some fine and the other money generator... probation, the better off they are and you as well....
 
My husband has had two DUI's and a lawyer has kept them both off his record, unsupervised (unpaid) probation, no community service no nothing but court costs and lawyer fees. Worth every penny. We live in a large city, they have plenty of public defenders. I've seen people who get no lawyers or cheap lawyers end up paying the same amount in supervised probation (me with just an MIP and no lawyer) than they could have paid a lawyer and not even messed with visiting their probation officer. Plus they have the DUI on their record, screw that. I hate admitting that we've had all this experience with alcohol and the law it sounds so white trash lol. Pay the money, get it taken care of and it will be like it never happened.

I think the advice of not getting a lawyer is horrible, thats why I have to keep commenting again and again lol. Get a lawyer. Its what they are paid to do, just pay them to take care of it for you. Its less stressful too.

May I ass-u-me that you always have the money for an attorney? In alot of cases, the $$ for an attorney are more or equal to what you would pay even if they got you no/less probation. Lawyers here are 3500.00-5K for a first offence, if they can get you off it's well worth it, BUT, if they just reduce the amount of fine/probation, you didn't do much. I've been in this business a long time, 14 years, I see and appreciate what you saying, but the advice isn't for everyone.

Thats fine, I'm not going to argue. I would still never be comfortable ever telling someone not to get a lawyer if they had a DUI, so I've said my peace :artist:

in cali, if you don't get a private lawyer - they know you have money and ALWAYS zing you big time with fines and DUI on your record. I have yet to see someone get off scott-free with a PD in a run of the mill DUI case.

PD's here have so many cases, they spend maybe 20 mins on your case and couldn't care less. Like Cindy said, get a PD if you want to pay money and get a record. If PD's did the same job as private lawyers - the private lawyers would go out of business! (guess what most PD's will become later on in their career).

If your husband had got them in Colorado it would have ended differently.
