Worker's Compensation...

I was injured at my job and sustained a torn meniscus in my knee, torn rotator cuff, and torn labrum in my shoulder...

What kind of settlement do you think I may recieve for such injuries? Doctor wants the surgery on my knee right away but workers compensation insurance denied my claim and my lawyer said the claims adjustor was just giving me the run around...

I was just wondering what kind of ranges I may recieve in settlement for those 2 surgeries that need to be preformed?

If it was course and scope you'll get the claim paid.

You might not get any settlement - your insurance company will have lien rights against any settlement (up to what they pay out).

Usually your lawyer will bluster to the insurance company about trying to get them to aive or reduce their lien. Some companies will, but if they know what they are doing (which is rare) then they don't have to reduce shit. (SOme state laws may force them to pro-rata the lien, I dont know)

So it depends who the insurance company is.
 
we get fuckheads like this all the time at work. they hurt themself a little injury and they take it to the extreme there just so fukin lazy. but in your case it seems like youve injured yourself pretty good. that sucks. sorry to hear that. you should get some good payments for that

Currently I am working full time and going to college full time as I need to pay bills. After standing for 10-15 minutes my knee gets extremely painful but must keep working. My employer said that if I needed a chair to sit in then I did not need to work. Well, the physicians assistant said the more I stand on it the more it gets injured.

I am not sleeping very well, in fact I get maybe 2 hours max a night of good sleep and need to take adderall in order to keep my mind focused at school.

My lawyer says I have a strong case and does not understand as to why they denied my claim other than the fact that I am young.

So now just to pay the bills I must continue to injure my knee because they will not pay me workers compensation...and my knee gets more and more painful every single day.

Any guesses as to a settlement amount with the above information provided?

Sorry that you have had all this happen, I hope you heal up like new in the future...why are you settling?
 
They paid everything, even time off due to pain, but that took some jumping through hoops. I kinda work for the gov in a way so it may be different from your situation,
 
See in my situation I have to work, no matter what, I have bills to pay. I am currently on pain meds to help me work so I can pay my bills.
 
wesley I broke my foot on the job and this is what happened...I was paid %100 of my wage untill I was able to return to work, about 2 months

you need to think long term then
you'll get "marked"
 
wesley don't expect any settlement from work comp. that is not the purpose of it. work comp will pay for your medical bills, rehabilitation if necessary.

DISABILITY insurance may pay a percentage of your salary, like 50 or 75% if your injury prevents you from going back to work for an extended period of time. disablity ins usually has a waiting period, like 30,60,or 90 days before benefits kick in. you may or may not have this coverage at your job. ask your HR or look on your paycheck for deduction.

you may have some sick pay coming. don't know what your employer pays for this., may depend on the time you have been employed.

to get a settlement you have to sue your employer and liability has to proven. this mean getting an attorney. it is a whole thing...you just don't sue and magically get a big old check.

i am very sorry to hear about your injury. this must be hard on you, worrying about your income and paying your bills. i am an insurance man. have writteb a lot of business insurance. PM me if i can be of help. injujries can be devastating.
 
For me worker's comp pay was 66% of my gross weekly pay, and that's not taxed, plus my company paid me the remaining 34%, for 22 weeks, and that part was taxed. They also paid for all medical expenses. Then after the doctor releases you they set up an impairment rating. There they will rate any reduction in range of motion, scars, etc.. Then you go before a worker's comp. hearing and they will tell you what they think the ins. company should give you based on your rating, and your pay at the time of the injury. You can appeal their ruling or accept it at that time. The settlement money that you get is also tax free.
