When applying for a job....

And they ask if you've ever been convicted of a misdemeanor......of course, you don't lie.....but how does one describe said infraction?? Would a "Yes" affect one being hired??

In my case I pled Nolo Contendre under the Georgia First Offender Act. My record was wiped clean after a year of probation with no incidents. I answer NO to the question. If I had to answer yes I guess I'd say what happened. Most applications I've seen only ask about felonies though.
A plea of nolo contendre allows the Defendant to avoid admitting guilt but accept punishment as if he or she had in fact entered a guilty plea.
 
just describe it how it happened, a misdemeanor shouldn't be a big deal.
 
depends on the infraction. Guarenteed the dude (or lady) hiring has skeletons in their closet.

Present it in a funny way. I told my now boss my DWI story. Just be honest. I can tell you 1st hand, if you are genuine, it comes through.

Ah ok.....well I'm filling out an online application - so no real room for a funny story at this point....

Basic story is about 4 years ago, I yelled at a lady who pulled up behind my car while I'm unloading luggage & she put out a warrant on me.... :rolleyes: Had to plead guilty to a harrassment charge, but they let me off everything else.....

I assume that will still show up.....

That is easy to make into a funny story. Just bring up that you thought about it when you were filling out the resume....

Don't do it for the online resume. Do it when you get an interview

That's the most penny-ante bullshit I've ever heard of. . .where the hell do you live?? So if you give someone the finger in traffic do you get charged with assault. I like the "traffic incident" idea. Not that I'm big on dishonesty but, during the original incident, when you were faced with Johnny Law, why didn't you just lie?? Hell no, officer! Never saw this asshole before in my life.

Yeah Jens just put "traffic indicent" or "traffic dispute"

If it comes to it later you can explain in person at the interview or something

Well, the thing is, the original incident occured in June or July....when she went home, she called the police - who apparantly came to my house while I was either 1) asleep or 2) not home as I never knew they came to my house....Didn't find out there was a warrant issued until OCTOBER when it came time to renew the ole driver's license......

So, basically I never saw the charging officer in the first place......
 
Another question: The company I used to work for moved.........guess I fill out their new address rather than their addy when I worked there??

Yes, use the new address. Make sure you have the right number for HR so they can confirm employment.

some of the companies i've worked for have been bought/bankrupted/moved so many times I can't find them.

That's why it's nice to have a good lawyer's contact info. I got one that is an ex-judge and knows the shit inside and out. Helped me out with my DUI temendously (also cost $10,000 :) )

No I didn't touch her at all......but for some reason, they wouldn't drop ALL the charges & insisted on this BS reduced plea....

they scare you into thinking that you may go to jail for 100 years because you yelled at some lady who was beeping her horn at you.

OK. But, certainly you were confronted at some point with the (bullshit) charges that were filed against you, right?? Like I said before, I always think that honesty is the best policy but, I would ABSOLUTELY have lied in that situation. Didn't do it. . .never saw this person before. . .don't know what you're talking about. Your word against hers. . .no way in hell you're charged with anything.

I agree with the others, though. I think it's bullshit and if I were asked I would tell your new employer the story. Personally, I love chicks that don't take shit from people. . .that's the way my wife is and that's one of the things that I love about her. She's not very big but, no one bullies her, including me (not that I would ever try). :)

Well, like I said.......I had no clue any charges were filed in the first place until license renewal time at the DMV when they said - Oh we can't renew your license cuz of warrants outstanding.....Once the warrants are issued, you can't "undo" them - it goes to court.....

I, of course, disputed everything at court - but that didnt' occur until almost a year later.....

how long ago was it? in our state, misdemeanors are off your record after 7 years. check into it.

Legally you can say what u want. Most they can do is fire you, which if u don't even get the job, is a pointless fear.

some companies CAN run bg checks on via private companies that buy criminal information from courts (big money maker). They prolly have 60% of all convictions nationwide, even way less for msidemeanors. So if it's just a misdeamor that doesn't reflect your character - i'd say no. Why let a simple DUI ruin say a job as a cashier. Makes no sense.

Unfortunately your options are now seriously reduced as a potential employee. You are paying for your past misadventures no matter how much you may have regretted it since.
