What does this sentence mean in a contract?

"You will be a full time employee and you will receive a salary of xx per hour with benefits."

Does the sentence definitively go one way or another with the way it`s written?

It was in a contract that had to be signed. Now they are saying there is NO overtime due to the fact that the job is "salaried", NOT an hourly wage.
 
To receive overtime it should have read:

"You will be a full time employee and you will receive a hourly wage of xx per hour with benefits."



It's pretty sneaky - but many contracts are meant to be thing when reading at a glance and another when you break them down.
 
I write up the contracts for my company to our clients and there are several loops like that one as it pertains to payment and hourly rates.

I have yet to see (in 8 years) a lawyer sign one our contracts without writing their own edits.
 
I have written Union language sevaeral times...Keys words in yours my man..."will", which denotes a requirement, and salary....meaning, you will be an employee and recieve "X" number of dollars each paycheck....

The sneakiest words in most contracts are generally...Will, shall, may, otherwise noted, should.....words like should and may denote options which most of the time come under the old..."Gray Area Argument"

OK, Thanks alot velvett.

They actually said in the interview that "overtime would have to be approved first". So, I did`nt think there were any red flags.

Lesson learned, I guess. lol
 
What are your job duties and what kind of hours are you putting in?

Guy's, this is the point of the current legislation being pushed by the Bush admin. Far to many people who need/deserve overtime are being screwed out of it.
 
ha! I must have a better job than you because I get paid xxx per hour.

Update, btw This was my wife`s job, They tell her now that the contract "was a mistake" and she DOES get overtime.lol

I`ve never heard of this before, If you work up to 3 hours overtime you get x amount of money, and if you work 4 hours you get x+ amount. That`s it. lol Well, at least it`s extra money. lol

To answer another question, she`s an Occupational Therapist. She has to see a certain amount of patients per day to meet requirements.

The overtime in question was 8 hours.

Like I said, It`s better than nothing. Thanks again for all the responses.
