weed is decriminalized in CA

I don't use it, but I think it's a good move. After all, they have proven in many ways, that pot is less harmful than tobacco or alcohol, which are legal in all 50 states. And imagine the tax revenue this will pump in! Maybe they can stop fining avocado farmers for having a shed that's a few square feet too big, or stop putting a huge tax on trash collection so that people might not tend to illegally dump loads of garbage on the highways.

Actually, there's a proposition on the CA ballot for November, which legalizes pot. I don't know what Arnold signed today, but I'll take a look. Not sure if this is something separate, or is part of the bill.

They've had "medical" for years...Bino, correct me if I'm wrong, but no drug enforcement will be actively pursued....That means you can smoke a joint in front of a cop.
decriminalized does not mean legal. medicinal use was legal, and has been in other states for a while now. technically federal law supercedes state law, so it was a gray area, but obama has said DEA won't interfere, and even before obama dispensaries have been operating.

it wasn't decriminalized before? lots of other states decriminalized it to a misdemeanor a long time ago.. surprised CA wasn't on that wagon.

You are correct, you won't get your door kicked in by five O for a few ounces of the icky sticky.....Try to bring a few bales of dirt weed from Mexico and you will be fucked...:)

yes you will. the bill is for one ounce not a few. Prop 19 will legalize it in November. With the naacp backing the bill it has a pretty good chance of passing. In the not to distant future we'll be able to purchase it over the counter wrapped up all nice and pretty just like cigs.

not to mention you can still get fined for possessing any amount provided you aren't a medicinal user.

Didn't realize you're a pothead...I don't question the right of people to use what they will...The only rec drug I've ever used/abused is alcohol. However, you should have been able to attain a prescription a long time ago...and cigs are so awesome...I wouldn't make that comparison in my marketing campaign. :)

you don't have to be a pothead to understand the law.

take that bee out of your bonnet java. Pothead? And you know this how? Oh it must have been my correcting you. My comparison was sarcasm, I thought you would have got that! FYI I'm not for legalization.

Decriminalized means reducing it from a misd. to a civil infraction
So no, no state has ever done that, technically it was still a misdeamenour for possession under a zip in CA, as in most other states.
loosely enforced here though...but my coworker got arrested last year for a few grams so it does happen.
but now it will be a civil infraction which imo is fair as fuk

Mass passed the same kind of law in Nov 08.
Good times
Piss off haters

personal usage is not really enforced much here anyway, as long as you are not driving, out in public, etc you're gonna be okay.
but now with it decriminalized, you will really be secure in your personal choice to blaze or not.
CA is strict on DUIs though, and even though the CHP is pretty pot chill they bust balls on stoned driving and like to give dui's for it, which is fair to me.
and finally, no you will not be smoking a joint in front of a cop anytime soon...out of respect for one, and two, because it's illegal to blaze in public so you will be citied the civil infraction

fuk the NAACP.
seriously though, have you not been following this prop?
it's not a slam dunk yes, polls show a tight race and the enthusiasm among big donators is not there.
Tight races usually mean failure for the prop votes...understandably people are confused about this prop.
how is it to be regulated, who can sell it, etc, etc.
a thousand things to consider and people are like fuk it.
I bet it doesn't pass this go round...which is alright, we can try again and in the meantime Arnold's measure is a step in the right direction.

I'm all for legalization and heavy taxation of mary jane. Cali needs da money!

YES.

And I don't know of anyone; myself included, who is suddenly going to start smoking pot just because you can get it at 7-11. People who smoke it will keep smoking the same amout, and will stop filling up the jails, and people who don't smoke it, still won't. And a few street pushers and traffickers will be in the bankruptcy line.

wtf kind of breathalyzer are they gonna need to develop to determine if you're dwb???

That's a huge problem.

I'm not an alcohol fan, but I get it. Guy drives erratically, takes a roadside skills test and then has to blow into a breathalyzer. And then, lawyers can argue calibration and other technicalities even when the field sobriety test looks pretty terrible.

Now with pot, what are you going to do? Someone can simply say they were tired, felt dizzy or might have a sudden bout of a virus when they fall-over from the roadside test. What's the alternative? Are we going to teach troopers how to draw blood now?

there is a mouth swab already in practice, i bet it will be the gold standard like a pbt machine is.
now the allowable amount has to be determined

no state has ever done that? 12 other states were decriminalized before CA. possession has only been a fine here forever.

a misdemeanor is still a "crime" by definition...

1. A misdeed.
2. Law. A criminal offense that is less serious than a felony and generally punishable by a fine, a jail term of up to a year, or both.

what are you getting at?

all I'm saying is that 12 other states passed the same exact thing before CA did. bino said no other state had done that.

i guess i'm saying that "decriminalization" to me means that...i can buy it through a legal channel and use it personally and, as long as i'm not breaking some other law (e.g. dwb...driving while baked) then, i can't be arrested, cited, or otherwise...until then it's illegal and, as such, if i'm caught using it, i am a criminal...i'm not a lawyer, but that's my understanding, capiche?? :)

makes sense. i guess the best way i can compare it is to use this example. there is speeding and then there is criminal speeding. both are illegal, but one is a fine and the other gets you arrested.

i'll agree with you that the term isn't exactly clear.

a "misdemeanor" is an "act discrediting to the profession" according to the rules adopted by the AICPA, the PICPA and the PA Dept of State Bureau of Professional and Occupational Affairs...i can lose my license...it doesn't need to be any more clear than that for me...until it's "legal"? i didn't inhale :lmao:

You don't have to take the field sobriety test or the breathalyzer in Ohio, you can refuse both. You are required to take a blood/urine test in Ohio if there was a fatality....which covers all drug use.

hmmm.. wonder if DUI testing for this substance for people that are in accidents or "endangering " the public while operating a motor vehicle..

An officer can perform exactly the same field sobriety tests for weed as they do with alcohol....they've been doing it for a long time. It isn't like people haven't been using weed and driving or operating heavy equipment since driving was invented.

Eating a cheeseburger, flipping radio channels or talking on a hands free phone is as dangerous as driving drunk...according to studies conducted by the NHTSA.

When I do cardio at 6 in the afternoon I don't worry about being run over by a drunk or pothead...I'm looking out for the sixteen year old girl texting on her cell phone.
