That's why you don't blow. :)

Point made. Refusing breath or blood test here is a mandatory revocation of your Drivers License for a minimum of one year.... I guess that is still likely better than the potential alternatives, though. But, they still try and prosecute you with charges of a DUI. I'm assuming that it is way easier to get charges dismissed or reduced without laboratory evidence. Interesting.

when i awoke in the tank the CO told me i was fucked and would do a miniumum of 5 yrs for battery of a peace officer
my world crashed, i felt like everything was spinning out of control.
thankfully the incident was recorded and it was plead to a misd
My attorney wanted to use PTSD and my military service at sentencing as a mitigating factor. I told him to not step outside the boundaries of the facts of the case.

Yeah that's how I got off, refused to blow.

You don't have to take the physcial field sobriety test either, which I made the mistake of doing.

If you know you're over, don't take any tests, bail yourself out and call a good lawyer.

Yep, you refuse all tests unless you're 100% certain you're under the limit by a wide margin.

Ohio only requires a mandatory blood test in an accident fatality. Otherwise, the breathalyzer or blood test is optional and you do lose your license for a year for refusal but your attorney has "wiggle room" if you refused all tests.

For my drunk and disorderly the doctor looked at me and said,"I can't believe you're drunk by our conversation, you shouldn't be alive with that BAC."

Everyone involved was shocked, including the prosecutor. :)

Felony DUI when I was 18

was doing 81 around a 25mph turn in my 71 chevelle.

Veered off the road, flipped 3.5 times, front passenger ejected and sustained major injuries. Dude wasnt wearing his seatbelt - he was life-flighted away. I broke my thumb, was knocked unconscious immediately. Guy in the back was fine, he got out and got us help.

$1400 in fines
35 days minimum security jail
5 years probation
some other shit

till next march. yeah, I agree that parents shouldnt have their kids have fast cars - haha. Sounds funny saying that, but its true. Must be getting old.

I went straight to the hospital after my crash - jail was a book and release, didnt even get naked. The minimum security jail thing was a joke, you could really walk off if you wanted to. You worked full time at a job (any job) and stayed at this place the rest of the time. "Work Furlough" is what it was called. One of the Enron guys was in there while I was in there.

DUI
Reckless op
underage possesion x2
drunk and disorderly conduct
obstruction of official police business
underage cunsumption

Three of those happened within a month of eachother resulting in two weeks in jail...good times

Here's my first one.

When I was 14, 3 of us were drinking down on the waterfront. I was tipping my head back and draining a beer, when a cop came over a hill and shined his flashlight on me. It was a serious "doh!" moment. He was rounding us up, and had his attention on my bros, and I tossed what I had in my pockets, 9 hits of sid, and a knife.

You can refuse breath and roadside but not the blood. Failure to submit to the blood test is 1 year liscense suspension. The above .16 "aggrevated" dui is horseshit and most of the cops I know hate it and the .08.

As for my record anyone who looks won't find anything it's been expunged.

Got a failure to stop at a stop sign ticked deferred and dropped.
Got assault charges deferred and dropped. Had to go to anger managment therapy, do community service, and was on proby for a year.

I've managed to talk my way out of several incidents somehow.

Cheers,
Scotsman

i've had to come face to face with my rap sheet in order to apply for a new job
not pretty, not at all

You can get a job? There are a couple spots here at the drive up window, I have to work three shifts to support the old lady. She has been eating and stuff lately.

I only had to do 15 yrs in the Federal Pen, the first 10 were the hardest. Me and Bubba got to be friends after that.

:santa:

im in the process of getting mine expunged. i was arested for something a former friend did and the charges were dismissed but good ole jacksonville loves to mess peoples futures up and keep it on their record even though it was thrown out. now i have to shell out $400 to get it done and im not even guilty. this sucks.

did any of this hinder your army enlistment?
I revised it for you so you can see were I went to the army.no it had no effect because before I went to the army most of a all my charges were on my "closed jew-v record and all the others were dropped.the few guilty I had I got wavers for and had no problem.....I scored a 86 on the asvab and if you score high like that they will jump a few hoops to get you in.

Damn bro. Damn.

What is that going to do to you when you go look for a job?

i've never been arrested.

although, i was a drug runner in high school. a serious amount. but i have an Innocent face.

i've never even gotten a ticket.

JH1 = Clean

I got arrested for DUI once, but the charges were ammended to some non-moving violation. I beleive it was something like failure to equip a vehicle with a proper muffling device or some bullshit.

Amazingly enough... I always escape getting caught and/or arrested.

I have a friend in jail for some crazy tax credit scam.. sad sad.

Nothing but a shitload of traffic tickets.

Oh - we're counting traffic tickets?
Well I have a couple of those - but nothing in almost 3 years.
My last insurance company dropped me.

They're still looking for you.

I almost got arrested for wadding up a ticket a cop had just given me and throwing it in the street. I was pissed for getting a bullshit ticket, she said now I'm taking you to jail and I said, "No you're not" and I got out of my car and picked it up. She just looked at me and I saw her in court a few months later because I decided to fight the ticket.

Nothing divorce related, it happened years after the fact. I actually set my ex-wife up with her current husband. I'm a giver like that.... :)
