My Controlled Delivery...LONG, full story

Thanks for sharing your story! I'm surprised that they could do all of that to you without you signing for the package. These people will intimidate the hell out of you. They try to make it sound like if you rat out it will help your case. It is always wise to keep your mouth shut and not say a thing until you get your lawyer.

Excellent post bro!

If you had not accepted delivery from the Postman would they have moved in?

I gotta go home and clean my house, I'm expecting a package soon!

Did it make the paper? That's what I fear most, a small town knowing my business.

Was the postman acting strange?
All in all, how much did the lawyer cost?

It sounds to me that the probable cause used by the cops for obtaining the warrant was based soley on speculation and anticipation. There were no exigent circumstances in this case whatsoever. My understanding of exigency means that if you aren't arrested/apprehended or secured immediately, something very bad is inevitable (ie. death, serious bodily harm, destruction of evidence related to a serious crime, etc.)

Screw the prosecutors, make them show in court that their evidence is legally sound. The first thing your lawyer should have done is file a motion to suppress the search warrant.
What's done is done, but in the future, as someone previously said, contact www.steroidlaw.com

damn, glad that you didn't rat out anyone. Do the crime do the time, thats how i am. Good that you didn't get any jail time. Feds shouldn't be going after us, but damn terroists!! Was thinking about getting gear through the mail, but instead decided to bring it back from cancun last week. What a risk i took, but paid off. Play now, pay later.

Seems like a lot of crap for such a small delivery. I think you were on the local authorities list. It sounds like you have a background and you probably bought pot from someone locally. They were watching you and this order/delivery gave them what they were looking for. Did you bang one of the local cops' wife or something?

"I think you were on the local authorities list"

That was my first thought as well. How did they know you had something coming? Did somebody set you up? Have you had a seizure before? Did customs know to look for your addy or was it just a "coincidence"?

Sorry for all the questions, just sounds kinda strange that's all.

answers some of your questions:

69muscle: 1.yeah, it made the paper, just a small blurb and no mention of specifics. 2. no, the postman didn't act strange at all and 3. my lawyer charged $2500.

jackfrost: my lawyer filed a motion to supress the evidence, and Rick Collins was the first person i contacted. he is not licensed in my state, he could only act an advisor to my attorney. after speaking with him a few times, i felt it wasn't neccesary

Enigmaxxx7: i dont have much of a record, so i dont think i was on their list. they said themselves that things were slow. and i have'nt smoked pot for years, so i doubt a local dealer ratted me out

they knew i had something coming because they were alerted by customs when the package was intercepted. i had previous orders siezed, so maybe there is some truth to the fact that customs flags addresses. also, i dont think anyone set me up
