WARNING:LONG READ....this is for those of you asking what really happens on controlled deliveries. my bust happened a few months ago, the first part of this is what i wrote from when i got home from lockup, so i didn't forget any details over time:
I was washing my car at approximately 11:00 a.m. when the postman (postal inspector) approached with a package. He asked if the address was **** and I answered yes and took the package. I set the package down in the garage area and continued to dry my car off. At this time unmarked vehicles swarmed the driveway, a black male got out of the car closest to me and asked if I was *****. When I answered yes he immediately handcuffed me and said I was under arrest for possession of narcotics and they had a warrant to search the premises. He the proceeded to walk me into the garage area while other agents entered the house. Moments later they came back out and said, "we're clear". I was then escorted into the house and sat down in the kitchen. I asked to see the warrant and the black male informed me that it was not my property, I didn't need to see it, and my parents would see it when they got home. They did not have a warrant at this time because a phone calls were being made to see if they had it yet. Also, other agents were complaining about the process of getting a warrant, saying that it took too long to get a hold of the judge in many cases. I was questioned about the contents of the package that was delivered and told them I didn't know. It was labeled as PC software, so I told them it probably was. I receive packages quite regularly, and explained the address didn't sound familiar but I do sign up to receive free items quite often. An officer then showed me two packages that had been stopped by customs and asked what I knew about them, and I told him I knew nothing about them. They asked me if I had any drugs in the house and I told him no. One agent began asking me for general information (name, address, phone # ect..) he was interrupted by a female officer because she wanted to read me my rights. Other agents were searching the yard and other rooms in the home. The officers again began to question me about the package, and trying to intimidate me. At this time a female officer opened the parcel and inside were 15 ampules of Sustanon 250 and one 10ml vial of Ketamine. They asked me what they were and by reading the label I was able to tell them the Sustanon looked to be testosterone and I didn't know what the Ketamine was. I was told I was a "low man on their totem pole" and they hadn't been very busy lately. They said if the drugs were for someone else, I should call that person and they would arrest him instead of me. I also was questioned about some of my old friends and they said they could make things a lot easier on me if I would sign up to be a confidential informant and help them make a few busts. I was also questioned about who was growing pot in the area. I told them I didn't know because I got myself out of that life many years ago. I tried to be helpful and told them when I was younger their were many residents growing in the town of ****, out of their juristiction in the next state. As far as things like heroin went I told them most of it was acquired from **** City. At this time another female officer was left to baby sit me while the officer who was questioning me went to search the vehicles including a sedan that it was later discovered was not on the search warrant. At one point an agent came out and said, "we have a whole pharmacy back there". They continued to badger me into cooperation and tell them about the drugs and it was at this time I invoked my Miranda rights. The black male that made the arrest said my mother was on her way home. Not much more was said and a little later the agents brought out two large paper bags, a desktop computer, and a 9mm rifle from my room. When an officer arrived to take me to the barracks I told the police to lock up my home and I was taken in. A female officer asked if I should stay until my mother arrived and the black male explained that he did not really call her. No one was notified of my arrest during this search and I was not able to call a lawyer when I requested, which I thought I had the right to do as an American citizen. The arresting officer even told me a lawyer couldn't do anything for except tell me to sit there and cooperate. He said I would have an opportunity to do so at the detention center.
well, thats how that happened. all in all, roughly 30 items were siezed from my home including, all computers, 2 guns, DNP (siezed by the FDA agent at my house), a bong, various legal pills and a cap-m-quick w/500 empty gel caps. i was charged with the following:
1. possesion of CDS, marijuana
2. possesion of CDS, not marijuana (sustanon)
3. possesion of CDS, not marijuana (ketamine)
4. posession of pariphenalia
5. posession of a handgun with obliterated S/N
i got a good lawyer and i had my day in court earlier this week. the state was looking for incarceration. the first plea bargain i was offered was plead guilty and go to jail (not much of of a bargain, huh?) of course i declined. i thought i had a decent case due to the validity of the warrent. on the day of the trial the states attorney took the arresting officers into a room and came out with a new plea agreement. drop 3 of the 5 charges, i would plead guilty on the sustanon and ketamine charges and she would ask for a suspended sentence. i decided to take this for the following reasons:
1. it assured me i would not recieve jail time
2. i was guilty, plain and simple and should be punished
3. if the warrent was legal, i had no case and would have gone to jail, it wasn't worth losing my job and having my credit go to shit.
in the end i got 18 months unsupervised probation, which my lawyer had adjusted from the original 12 months supervised set by the judge. i got 32 hours community service, a few thousand dollars in fines were waived, but mainly i learned a valuable lesson in,life.
BTW all this was done without being a rat, although i was pressured many times by various agencies. if you are going to break the law, be man enough to take what is coming to you
