Plus yes, it most likely is illegal. In most states when you work a certain number of hours, you are entitled to a certain length of time on paid break, usually 10-15 minutes for each 4 hours worked or something like that.
I believe you're entitled to one 30 minute lunch plus a 15 minute break if you work 8 hours, but if you're 15 minutes late you're only working 7:45. I seriously doubt they're staying late to make up for it.

I had a help desk job where they not only timed every call; they timed how long you took yourself out of the queue between calls (to document the call in the system). If the call was too long you should have just escalated it. If you were out of queue too long you need to type faster...or you were just lazy.

In California, the Industrial Welfare Commission Wage Orders require that employers must authorize and permit nonexempt employees to take a rest period that must, insofar as practicable, be taken in the middle of each work period.

The rest period is based on the total hours worked daily and must be at the minimum rate of a net ten consecutive minutes for each four hour work period, or major fraction thereof. The Division of Labor Standards Enforcement (DLSE) considers anything more than two hours to be a "major fraction" of four." A rest period is not required for employees whose total daily work time is less than three and one-half hours. The rest period is counted as time worked and therefore, the employer must pay for such periods. Since employees are paid for their rest periods, they can be required to remain on the employer’s premises during such periods. With respect to the taking of rest periods, an exception exists under IWC Order 5-2001, Section 12(C) for certain employees of 24-hour residential care facilities who may have their rest period limited under certain circumstances. Another exception to the general rest period requirement is for swimmers, dancers, skaters, and other performers engaged in strenuous physical activities who shall have additional interim rest periods during periods of actual rehearsal or shooting. IWC Order 12-2001, Section 12 (C).
 
If your employer fails to provide the required rest period, you are to be paid one hour of pay at your regular rate of compensation for each workday that the rest period is not provided. If your employer fails to pay the additional one-hour's pay, you may file a wage claim with the Division of Labor Standards Enforcement.

I believe Pennsylvania entitles you to one 15 minute break every four hours plus a minimum 30 minute lunch break. No such animal in FL, they can can you for being late the first time.

even with all those laws that stuff doesn't matter here. I can take a "break" whenever I want.. long lunch..come in late.. leave early.. what matters is performance.

If I told one of my employees that they don't get a "break" because they were 30 mins late, that is going to have a HUGE negative impact on performance, I doubt I'd get any decent work out of them that day. Better to just casually mention (which I do) what time they are expected to be in.

In NY it's an hour break if you work eight hours, a half hour and 15 if you work six or more, and 15 if you work 4-6.

(edit: I stand corrected on the VA thing)
