is this discrimination? (really serious issue at work)

Okay, here's the backstory.

One of my coworkers is pregnant and getting married this week... last week we had a tough patient that required lifting. From the boss: lighten her workload, you take the difficult patient. Okay fine, I'll try to be a team player.

Last week I got sick and havent been back to work since. I email the boss saying I'm healthy again, he says no, she's getting married this week so we cant take a chance on getting her sick.

Okay seriously, we see sick people every night and she still works. Is he discriminating against me?

how can she get 'sick'? tell ur boss to get someone else - cuz you're sick.

Sorry, I meant I emailed him an update and that I'm better... he then told me it was too risky to have me back at work since she's getting married we cant get her sick.
 
Are you making that up? That makes zero sense. If your boss told you not to come back even though you are better...

You have an updated resume?

Do you get paid hourly or on salary?

That is rather bizarre - unless she's isolated from these patients which it doesn't sound like to me.

HeatherRea might be on to something with having your resume ready... just in case.
 
Heck yeah, I'd stay at home and play video games in the nude all day long if my boss told me NOT to come to work.

What are you complaining about? Unless you are not getting paid or it uses up your vacation.

I presuming by the tone of this that you aren't getting paid for these days of leave?

As in you are a contract worker of some sort?

I doubt you have any viable recourse in any case - especially if you wish to continue the relationship where you get paid...
 
I think he is trying to tell you to get another job... What is your work attendance? Have you made enemies or have you missed alot of work? That scenario makes no sense.. If you want to continue with your current position, then I would speak with him first about his meaning of his comments.. If you do not recieve a satisfactory response, then go to the next level of leadership.. good luck...
 
What were you sick with? I may have overlooked that part.

If you are getting paid, then stay home. If not, then file short term disability and take another 3 weeks off.
 
WOW thanks for all the responses. I work in a sleep lab, testing people for apnea and narcolepsy and stuff. I have a real gunner for a boss who thinks he's a doctor; and likes to usurp the authority of the level above him in the company.

I am getting paid to stay home right now. The unfortunate thing is that it's depleting my sick time to the point I'll have 0 hours for anything else for the rest of the year.

It's no real problem for me to get a job in medical testing elsewhere, I have a degree and the associated medical credential. I guess I may have answered my own question here.

OH

Go to your accounting department (or whomever keeps track of sick days, personal days and what not) and tell them what happened and the dates you WERE sick, the day you spoke to your boss and what he said and how long, you should not lose sick days because of that.

That's just opinion though - I would certainly try.

That's exaclty what I would do

It doesn't sound like your boss is trying to give you the "boot", he sounds truly concerned about the preggie lady. Which I think is cool.
 
Yep, I agree with Vel, but I would be paranoid about my job still. I'm the paranoid type, though.
