What's the law in FL, Matt (in relation to taking blood or fluid samples for proof of DUI) when one refuses a breathalyzer?

You have the right to an alternative test.

The state can only take blood in the event of an accident, and then they require a court order. if there is a fatality then the order is not needed.
 
Drunk drivers should be strapped into the car and have it pointed toward a brick wall with a cinder block on the pedal.

Only if they actually cause an accident. Many people drive intoxicated without incident.
 
the way you generally should play it in California atleast, is refuse breathilizer and roadside garbage tests but tell them that you will take a blood test. You will get hassled but blood tests are more accurate and precise than breathalizers and roadside tests are set up in such a way that they can never help you and only hurt you.
 
well in ca, if you are underage, there are several different possibilities.

IF under 21, you can drive with up to .05 % bac without getting a DUI. You WILL however lose your license for a year MANDATORY if you have anything over a .00 You do not have to pay any fines and you do not get arrested. Your insurance will fuck you though. If you have over a .05 and you are under 21, then you will get a full blown DUI and have to pay the 1500 in fines in addition to taking all kinds of stupid aa courses and what not. Problem with being a minor here and getting the .05 or lower violation is that you don't go to a real court.. you have a dmv hearing. My roommate hired an amazing attorney, and he had almost NO effect on the dmv hearing, the license was revoked and now they have to appeal it to get it to a real court so that the attorney can have some real say in the matter. It's a real headache. O yah, and here, if you refuse the test, it is an automatic admission of guilt. It's part of the "oath" you take when you get a drivers license.
 
it's been 6 months.

trial is next month. hired an ex-state trooper to testify on my behalf on the inaccuracies and unscientific approach to the field sobriety test (which I took, and DID NOT know that I could have refused, which would have gotten me off easy) this guy used to instruct police on how to administer the tests.

should be an interesting jury trial.

It's different state to state so really only someone with DUI experience in your state can tell you what the deal is. But most likely you are going to have a suspended license for 3-6 months. And I'd expect the order too cost $500-3,000. I had one DUI and that was enough for me. Drinking anything more than one beer and driving just isn't worth it.
